Hi all,

I am OINP PNP permanent resident applicant, currently waiting for PPR.
Because my work permit expired two months ago and I applied extend work permit application before expiring date, I was able to continue working as an implied status.
Two days ago, immigration officer refused my application for extending work permit due to I chose Open Work Permit in the application form by mistake.
Thus, I am currently out of status and not able to work in Canada until my restoration application gets approved.
Now, my permanent resident application, I passed all steps including security and got ghost update three weeks ago. This is almost end.

I asked immigration lawyer and consultant in Canada, they said that if changing job or position, then it does affect PR application and cancelled. However, because you are just stop working (their meaning: NOT necessarily work constantly until your PR gets approved) and legally living in Canada, your PR application will be fine.

Does anyone know this it is correct? Stop working due to visa refusal does not affect PNP Permanent Resident?

Thanks,

P.S. I want to say one thing that immigration processing time is VERY slow! I have been waited this for 16 months now! If I got approved PR beforehand, then this situation would not happen!

Hi, what’s your OINP stream? Is it a job offer stream?

If your work permit have employer restrictions then you should stick to your current job

Okay. Then, how about my PR? If I do not find other job, but just stop working and living in Canada, then will immigration officer cancel my PR?

You can't legally work in Canada until you have a work permit, other things are secondary. Its recommended to keep working after you get your work permit.

Did you have an post graduate (open) work permit before applying for extension?

No. I had just normal open work permit.
My PGWP only valid for 4 months because of my passport. So, last year I went to my home country to exptend my passport and at the airport, they saw my nomination and support letter, they just gave me new OPEN work permit. Not sure why the officer gave me OPEN work permit, but will my current situation (cannot work) affects my PR?

how come you get rejected, if you have file number than you are eligible for getting open workpermit.

I checked nominee certificate and there states "Restricted Condition by ... company."
So, I had to apply as "Exemption from LMIA" instead of "Open Work Permit."

You should call them. My friends had to call 3x to "remind" them to send the instructions. From approved to email it took 2 months

Thank you. Its been 3months for me now. When I called two weeks ago, she said call again once we reach 21 business days which is the time frame for resending the email. I send them a message instead, and got a response saying it was forwarded to the right department.
I asked them for a landing appointment since I already lost 3 months due to their system error. I would be really mad if they said we will resend it again, wait another 21 business days...... I will give them few days, and will start pestering them every single day, until they are sick of me haha
My application is approved, so I dont really care what they will write in the system notes :)

I even asked them to resend to my work email, or fax. But knowing them, they will keep trying to email me to the same email address, instead of all 3 options.
