I will really appreciate if someone can provide any suggestion to situation I am facing,
I have worked in a pharmaceutical company (Chinese culture based scale like 120 employees) for more than a year now. I primarily report directly to my QA/ RA manager. She is authorized to approve some major business agreements and other Quality documents.
Initially I did not expect this company for any immigration help. I went to HR solely for a my annual performance review for the purpose of increment (as given to other Chinese employees too). She refused to give my any raise but said that they will cooperate with my immigration instead.
I filed for my PNP and hired a consultant keeping in mind the verbal commitment that my HR gave. As directed by my consultant I gave employment letter signed by HR. My consultant said that my immediate boss can sign on Use of Representative Form and other documents on Employer’s behalf. So my QA Manager signed after reviewing and reading the documents. At this point I had assumed that my HR and QA Manager know that they are helping me in PNP and not express entry because of the verbal commitment my HR gave. At various times I mentioned to my HR that I have hired a consultant on my file’s behalf and it is PNP. But when this HR got verification call she refused that they did not support my application and are not aware of any representative hired and asked me to withdraw. Even though my QA Manager signed on the Use of Rep form by reading and knowing her authority, the immigration advisor thinks that I misrepresented the information by not getting it signed by HR. The immigration advisor is not verifying the situation with QA Manager but instead just believing whatever HR said to her.
I also came to know that HR lied to me that they never supported any PNPs whereas some Chinese employees have been supported by this company by PNPs.
I do not understand that even though QA Manager also takes some major decisions in the company, why her approval on my PNP is considered misrepresentation?
Also is there not any defensive argument I can make to immigration that the HR and president have lied to me various times for not giving me raise but promising supporting my application?
Right now HR has already confirmed to immigration to close my file but I am looking for at least some justification.
