I had applied for my PR under PNP- CEC on July of 2018
In March of 2019 when I called IRCC, my application was moved to India due to work overload in Canada (Sharing of work)
I had been waiting for well over 2 years and November 2020, I got to know my PR was refused. (I did not receive the PR refusal letter from IRCC yet). It shocked me. Because I believed I had a very strong application with over 1 year 8 month Canadian experience. The reason for refusal through the MP received was mentioned that I had not received 1 year of full time experience in my NOC. (As CEC requires you to have a total 1 year of work experience in the last 3 years combined and it could be in any NOC) Which sounded weird as I did have the experience.
Few days later, I immediately drafted a formal letter to reconsider my application giving my history of employment here in Canada and highlighted the rules of PNP -CEC Class to the best of my knowledge and sent it to IRCC.
In the meantime I ordered my GCMS notes to know what my case is all about and how I have been evaluated, since I had no refusal letter from IRCC yet. In the meantime I hired a lawyer. 30 days later in the month of December 2020 I received my GCMS.
Through the GCMS notes it was identified by my lawyer that there were multiple errors committed by IRCC in evaluating my application that contributed to refusal of application. Below is a gist of the errors
1) Incorrect job history (Omitting out multiple job experiences and overlapping work experiences history dates)
2) Incorrect Marital status (made me a married Man, while I am still single- It interestingly also mentions that ID Card of accompanying spouse has been provided)
3) Incorrect lock in date- I applied in July 2018 while it shows March 2018
4) Incorrect category of Application, which should have been PNP-Canadian Experience Class instead I have been evaluated under Federal Skilled Workers.
All these errors in evaluating my application, eventually contributed to the refusal of my application by IRCC.
In the Month of January 2021 my lawyer sent another letter of Justification identifying these errors and highlighting all the rules and policies of ONIP_CEC Class and sent to IRCC India since my application is in India. I requested IRCC to correct the errors and reconsider my application.
I have not heard back from them with no letter, nothing. I have been in Canada for over 7 Years now and been waiting for my PR for almost 3 years. I had to resign my job as my work permit extension also got refused due to these errors.
I am now living in hope that they correct these errors and approve my application by the earliest. The wait has been frustrating and stressful. Hopefully they reconsider and I get what I deserve
