Does anybody know how long does it take to appeal for your pr after you got reported from CBSA? I am so worrying right now. My case is I just got a job in Canada but my pr card is already expired and I didn't meet the residency requirements. Last time I got into Canada without any problems and luckily I found a job so I was gonna stay for two yrs and apply for a new pr card, but due to family emergencies, I left Canada and back to the u.s.a with my expired pr card. What will happen to me when I return to Canada? Will I lose my new job too if I got reported from CBSA? Can I reappeal? When I return to Canada should I show them my expired pr card along with my u.s passport or just my passport? I am just wondering if I got reported at the border what will happen to me? What will happen to my job? I really appreciated if anybody can answer my questions here...thank you!!!

If you aren't reported when you enter Canada, then all you have to do is stay in Canada until you meet the residency requirement and then apply for a new PR card.

If you are reported when you enter Canada, then you will have to appear in front of a judge to argue why you should be allowed to keep your status. If you win, then you can keep your PR status and continue working in Canada as a PR. If you lose, then you will be ordered to leave Canada and will have to stop working. If you want to return to Canada and work as a foreign worker, then your employer will likely have to obtain a labour market opinion and then you will have to apply for a work permit.

Thx... I need to know how long does it take from the time I got reported at CBSA and lost the case then reappeal again? I have kids that live in Canada and I have to be around them. If I lost my pr card, can I reapply with the kids' mom sponsor me again? Do I have to show them my expired pr when enter Canada?

1. You have 30 days to appeal the report.

2. Hearing before the IAD takes 12-18 months to be listed after appeal depending on your city and province of last residence in Canada.

3. If you/ CIC lose the appeal then you can apply for leave to appeal before the Federal Court.

4. If FC grant leave to appeal (on a point of law) then 12-18 months again for listing.

5. There is no further appeal to the FCs decision in 3 or 4 above.

6. If you win then you keep your PR. If you lose then you get issued a removal order and have 30 days to leave. If you don't leave in 30 days then the order becomes a deportation which you don't want to happen.

7. Sure you can be sponsored again and will get PR if all criteria met. If you accept the Residence Obligation breach why waste the courts time and tax payers money just relinquish PR and re-apply.

Time lines likely will shorten as reforms to the refugee system which is the major cause of the backlogs (unfounded time wasting claims) take place.

You can live, work etc in Canada until appeal is decided.
