Hi everyone.
Please I need help and advice.
5 yrs ago I was in jailed due to false accusations and charged me 2crimes that I never did. Been in jailed because I need to undergo court trials but after 4months I got discharge because there are no complainant showing up and no complaints since the beginning.3 yrs. ago I got a permanent dismissal and finally my name is clean.

Before I got married I told everything to my husband and he understand and accepted me.

My husband consult to a friend that have knowledge and asked her to teached me and helped me to my application.

I told her about my story specially that painful thing happened to me. There is in the spousal sponsorship application have a question if you been charged,detained,charged or incarcerated. .
I consulted to her and she told me I can answer no but have to make an explanation letter and attached all court documents and clearances.
So I followed her even I am in doubt and I ignored my thoughts because my husband trust her.


I got headache because I am always thinking about it..thinking if it is the right answered.

We file application for spousal sponsorship last december 2015. And now my application is on process.

I plan to make a letter to correct my answer and is this possible to do ?

I make this up because my husband wants me to apply for visitors visa and in the application there is again same question. And I plan to answer YES..

Back then I am in deep thoughts because I dont know what really to do and to make it up.
My answer must be both the same in the 2 application but I cant ignore that I been charge and got into jail even I did not made the crime.nor found guilty or convicted.

Is there a way to make it right or any possible way?


Please what will I do. Anyone please help me

You should refill that form, and this time answer yes. You have already sent an explanation and all the needed documents with your application, but I would include the explanation again and state all the documents needed are with your application. Also state that you originally answered 'no' because you misunderstood the question and thought that since the charges were dismissed that 'no' was correct.

You can send this to the visa office processing your application and ask it be added to your file. Include your name, your sponsor's name, your birthdate, his birthdate, and the file number.

The answer to this question should be the same on your TRV application and PR application. 'Yes' in both cases.

Unfortunately, your husband's friend gave you bad advice; you needed to answer the question truthfully, which would have been `Yes'. You were charged, even though the charges were eventually dismissed.

You need to send an updated IMM5669 (Schedule A Background Declaration) to CIC with a short note explaining the situation. If you have your application number or UCI number, you can send a Case Specific Enquiry and attach a copy of the updated form, but you will also need to mail it to them, because it requires a signature. CIC always needs originals.

I need advice again..please help
It is possible to submit together the new update imm 5669,and short explanation letter with my visitor visa application?
is visitor visa application will be send in the same address where I sent my spousal sponsorship application in Canada?
Btw,I made an online account in MYCIC cause I plan to apply online for my visitor visa but then I change and I would like to send through paper application. Is this possible to do the paper application after I made an account to MYCIC?I dont put anything yet to my account in MYCIC.
Please advice me of step by step on what to do.

You have to submit the updated form and the explanation to the visa office where your PR application is being processed. It should be clearly labeled that it is to be added to your PR application. Do not just send it with the TRV application.

You can include a copy of the explanation in the TRV application. Otherwise the two applications should be kept separate.

Hi. Thank you for the response.
It is ok if I will only send the update form and explanation letter to the cic without attaching those court order and clearances because I already had it in my application...or still I need to attached those documents again?
I will make a paper application this week.
This updated form should I need to send ahead or first before I apply for visitor visa(TRV)?or can I do both on time together?
I will send the updated form in cic with the letter in priority mail after I will go to VAC/CVAC for my paper application...is this possible?

Btw, do I have a chance to get approve for my PR even I had charged of crime?

And it is necessary to show my bank statement for visitor visa...is really require that I have money in my bank even my husband will going to shoulder everything?
