Pls. Help in need of a miracle for Newly weds

Hi guys,

I'm new here in this forum and i've read a lot of stuff here. It is very informative but I have yet to see a scenario like mine. I was a student and was almost done but i failed my thesis and i'm currently in a visitor status now. I met my girlfriend three years ago and she knows everything about my situation and she will be sponsoring me. I'm currently still living in Canada with her. We also moved in together last december and just got married this september 10, 2015.

My problem is that my Visa will be expiring on october 15, 2015. The same day my passport expires. I've tried to renew it from the Indian Consulate here in Vancouver. At first, the passport officer we talked with looked at my application and we told him everything about my situation and he told us that he would provide me a temporary 2 year extension after he gets clearance from the embassy where it was issued (the passport was issued in philippines since i was born and raised there) A month passed and i was getting worried but at the same time I was getting ready all the requirements needed for the sponsorship. The passport officer called from the consulate and told me on september 10 that he got the clearance and i just need to come to bring my passport and application. I was glad that i got the clearance and i told my wife about it. But the next day the passport officer grabbed my passport and application and went inside his office and then came out and told me that I need to provide him with the Marriage certificate that has been notarized by a lawyer and approved by the Attorney General. He also asked me to provide him with a File Number when we do submit the sponsorship application.

I understand the marriage certificate comes in around 2 weeks after the marriage which won't be a problem but I am at lost at how can I provide the File number for my sponsorship application when it takes 2-3 months for it to be processed and by that time I won't have a legal status here in Canada and at the same time my passport will be expired. As i also was informed that a valid passport is needed when submitting the application.

I'm at lost and me and my wife are trying to contact the Canadian immigration for some help about this. My wife is worried that we won't be together after this and I am too.

I would really appreciate any help from you guys. And I would also like to point out that when I talked with the passport officer, I told him that its not possible to get the file number right away that I can provide him the marriage certificate within 2 weeks, he just didn't care. My own consulate is treating me like this.

I talked with my lawyer and he told me to just submit the application and see what happens. So far, thats the only option I have and my wife wants to do it too and we're running around to get whatever we can ready. I have already applied for police clearance and I still need to do medical.

You're in a tricky situation.

I don't think CIC or the Canadian Consulate/Embassy is going to be able to help you in any way. Your problem is with the Indian Consulate.

You're right in understanding that you won't have an application number until a few months after you have submitted the application. There's no way to get one sooner. And yes - you need to have a valid passport when you submit the application for sponsorship.

Are you submitting an inland or an outland application?

FYI - you can submit the application without the police certificates and let CIC know you will be submitting these later.

Thanks for the reply. The application will be Inland since I am here in Canada already and my wife is a Canadian Citizen who lives here and I didn't knew that I could send the Police Certificate later. What else can I send after I submit my application?

I believe you can do the medical later with inland (along with the police certificates) - otherwise everything needs to be included with the original application.

If you can submit the application and have it reach CIC before your passport expires, you should be fine. You should include an open work permit application along with the application.

I submitted mine without the marriage certificate and a note it would come later. It did not take 2 weeks, it took 3 months, so it might be something to consider.
