Hi guys,

I received a Procedural Fairness letter couple days ago. They want to charge me with misrepresentation because I forgot put one of my previous job on my employment history.

My question is "Is it too late to withdraw my case?" My lawyer told me that it is OK to withdraw. However, I found some cases on this forum that people got refusal and charged with misrepresentation even after they sent withdraw request. Does CIC has the right to refuse my withdraw request?

Thanks so much for any advises.
 
Yes - CIC has the right to make a finding of misrepresentation even if you request to withdraw the application.

It doesn't make any sense. Why would they keep processing the case if the applicant ask for withdrawal.

1. Think of it this way. You rob a bank, get caught, tell them that you will return the money if they will forget about it. Works the same way with Immigration, you misrepresented yourself, CIC found out, and you think that by withdrawing, CIC will forget about it?

Was it actually a case of "misrepresentation" or an honest omission?

how did they come to know about your previous job not included in the employment history?

Dear its better to defend the case rather than facing the charges of misrepresentation that will put a ban on you for 5 years.I also faced the same situation though verfication took place from irrelevant persons i want to remove this Tag of misrepresentation and make myself clean further it depends on me after clearance and they find me innocent idont pursue further or dont opt thier PR.

If it was an honest mistake, your lawyer should be able to argue the case.
