Hello Friends,

Could you suggest the best course of action for the following situation?

1. I applied Canada PR in 2010
2. I received my Canada PR in 2012, did landing formalities, obtained SIN in June 2012, and returned back to US. Did not stay more than a day in Canada.
3. I did not move to Canada, thinking that I will get my GC in the USA but over the past 8 years, I have no luck.
4. I have a permanent job in the US. But I am thinking to re-apply for Canada PR again, under Express entry.
5. I know that I cannot apply for new PR, unless I surrender my existing PR.
6. I am getting 437 points (if I apply before August 1st week), else 432 (if I apply after August 1st week), as my birthday is in August.
7. I do not have my IELTS yet, but I am confident that I can get a good score.

Questions:

My goal is to place Express entry application before August 1st week. With this constraint, I have the following questions:

1. Do I need to surrender my PR to place my application?
(Or)
Can I surrender my PR, upon getting an invitation to apply?

2. If I have to surrender my PR before placing my application, how long it will take to cancel my PR, so that I can place my new application?

3. If it is going to take a long time to get my current PR canceled, can I place my current PR cancellation and new express entry application simultaneously?

4. I am not sure if I am able to get my IELTS before August 1st week. So, can I place express entry application with some scores mentioned, but later update the application, once I receive my official score?

5. What are the chances of getting an invitation with a score of 432 or 437? I see that last year it reached less than 430.

6. What documents are needed to place express entry application? How much is the fee?

Surrender your PR now. It can take a while to process the request. If you wait until you have ITA, then the process may not be completed by the time you submit your application and this could result in your PR application being refused.

Surrendering your PR should not take longer than 2 months - although we've seen a few cases here where it has.

You cannot submit an Express Entry profile until AFTER you have taken the IELTS test and have your results.

Hard to say what the chances are of getting ITA with a score in the 430s. It dropped below that last year but no one knows what's going to happen this year.

Information about how to apply for PR under EE is on the IRCC web site (including fees). If you want someone to handhold you through everything, best option is to hire a lawyer.

Thanks for your reply.

I just want to confirm if the following is a valid approach?


1. Place a request to Cancel current PR (immediately)
2. Get IELTS score (in 1 month)
3. Place application for express entry (in 1 month)
4. If I get ITA before my PR is cancelled then just wait till it gets cancelled and then submit the application (since I have 90 days to submit the application after getting ITA).

So we can place the application in express entry while the current PR is active (or submitted for cancellation)??
