Hello Sir,

My fiance is here in canada on student permit.
She will be applying her 1 year OWP next month. We are planning to get married this December.

Would it make sense if
I sponsor her PR in Jan 2016? Or should i get marriage certificate next month for her PR application ?
Should I apply as Inland or Outland? I don't want her to be restricted that she cannot leave country, neither would want her to leave country if file has not processed till her OWP expires.

Please suggest whats the best approach in my case.
Is it recommended to hire lawyer?

she holds student permit so she can apply for off campus work permit. then she can work and study while she wait for her pr.
or if she is done with school, she can apply for post graduate work permit , then she can work anyway.

3. not sure if I understand correctly.
it sounds like you would have a wedding on Dec. cuz you could get marriage certificate next month.

If so, I would apply now - gather all docs and proof of your relationship and explain about wedding on separate sheet of paper etc.

Makes sense, but with outland can she cross border to usa with valid student permit? (she holds Indian passport)

Open Work Permit. Yes she will apply for post graduate wp once she is done with course

Yes wedding is in December, but to speed up PR process I was thinking of getting marriage certificate in city hall. I can get marriage certi 3 months before, so question is can i apply PR sponsorship file with marriage certificate

Yes - you can apply with just a marriage certificate. However you will need to include other evidence to show the marriage and relationship is genuine.

You should submit all evidence with the original / initial application. There is no guarantee you will be able to submit additional evidence later.

Yes she has USA visitor visa.
If i am not able to submit additional docs later, how will i prove that we got married.
For now i have all evidence of engagement and relationship, for marriage in Dec i can attach invitation letter. But applying few months before wedding, would it have chance of delay/reject the file?

Getting married or applying common law will have the exact same wait times. There is no way to "speed up" the process.

If you want for her to have the option to travel, I would suggest applying outland. If she applies inland, and for some reason they don't let her back into the country, your entire application will be rejected, you'll lose the application costs, and you'll have to start all over again.

If so, you can summit photo of that day and marriage certificate as proof of your wedding.
then explain that you would have formal ceremony on Dec.
( one of forms asks if you have wedding and go to honey moon etc so you can explain that ).

Thats great info.
So i can start preparing the file and once I have marriage certi, i can submit my outland app.
So after December should I send proofs of marriage.

It'll likely be processed in New Delhi, as applications done outland are processed in your home country's visa office. Ottawa is a bit of an exception - it seems that many US applicants end up being processed there, but for the great majority it will be elsewhere.

I and my fiance are in Toronto right now.
What options do we have to get marriage certificate here to initiate the file process. I won't be having a big ceremony here in toronto.

Haven't some of them ended up in Mississauga as well?
