Please Please... help needed on Spouse Open work Permit

Dear All,

I live in Canada and have TRV(work visa) and work permit 1 year. My fiance lives in Delhi, India. He don't have any kind of visa or permit to come to Canada. Also he don't have any job offer from Canada's employer. I come to know that the fastest way for him to come here is to apply "Spouse open work permit". Please correct me if i am wrong that part. But if, I am correct, Can someone please give me detailed process to apply SOWP in Delhi. Or give my links where detailed information is available.

Its really important please do help. I will be really great full for all of the people for giving details

Probably it will be best if i'll give all details that I know and then You can guide me where I am wrong.

I am thinking to apply his SWOP via VFS office in Delhi, India.
He has to fill and submit following forms and documents for his SOWP,
1) IMM1295 form (for open work permit)
2) IMM5645 form (Family information) ?
Is this form is only have to filled by him. OR do i have to fill it too separately?

3) IMM5753 form (Medical form)?
Does he have to fill this form too while applying via Delhi VFS office?

4) medical certificate ?
Please guide me on this as i dont know whether he have do medical exam before applying or after submit application.
While going into hospital for medical does he have to have a specific receipt or document which will show that it is for immigration ?
He is going to submit the SOWP application in Delhi VFS office, is the medical exam has to be from same city i.e. delhi or it can be any other city provided its valid medical examination center mentioned on CIC site?


5) IMM 5257 form (Application TRV) ?
Is he have to submit this form at time of applying SOWP? Do I have to fill and submit this form along with his application?

6) Attach copy of his passport and photographs
7) Birth certificate
Police Certificate ?
Is police certificate is mandatory in SOWP? If yes, then how long it is valid 3 months or 12 months?
He can get the police certificate for India. He also lived around 8 months in UK. Does he have to provide the Police certificate from there also?

9) Ielts General score sheet
10) His Joining letter of current employer and salary slip
11) His experience letter from previous company, salary slip from previous company
12) Bank Statement for past six months

My Documents
1) Invitation Letter on his name
2) Attach copy of his passport and photographs
3) copy of work permit and work visa Canada
4) Birth certificate
5) Police Certificate
6) Master Degree from Canada Transcript and certificate of completion
7) Ielts General score sheet
Joining letter of current employer and salary slip from Canada
9) experience letter from previous company, salary slip from previous company
10) Bank Statement for past six months

Our documents
1) Marriage Certificate
2) Photographs
3) My Flight ticket during our marriage time

Please guide me
1) Is there any other document require to submit SOWP ?
2) Once me submit above written document for SWOP permit then do he have to apply separately for work visa?
3) How long it will take in processing after submitting the the application?
4) which method is better online or applying via Delhi VFS office ?

Hi,i have applied for SOWP on the basis of my husband as he is studying in canada.

I have submitted following documents to VFS,Pune

1. Academic Certificates (10th,12th,Graduation,PG,Other)

2. Degree certificate

3. Experience letter

4. Proof of funds( PF, FD, savings account)-if you are showing parents saving,you need to provide declaration of sponsorship

5. Marriage certificate

6. Photographs(http://www.cic.gc.ca/english/pdf/photospecs-e.pdf)

7. Filled application forms (Validate them for bar code before you apply.You will get application Number on each page)

a. IMM1295E

b. IMM5257B_Schedule1

c. IMM5645E

8. VFS Checklist(http://www.canadainternational.gc.ca/india-inde/visas/checklist-workpermit-permis_de_travail-liste.aspx)

9. Sponsorship/Reference letter(attached)

10. SOP(Statement of Purpose)

11. VFS consent form(you can print it home or VFS will give you)

12 . Applicant's spouse passport copy Study/work permit/both

2) And i your spouse is applying for SWOP then,he doesn't have to submit any application separately for work permit
3) If you are applying through VFS then processing time will be 20 working days.
4) In my opinion applying through VFS would be better.

Can you give me some more details. As when i was checking the IMM1295 form there is no option to select SPOUSE OPEN WORK PERMIT.
Where did you mentioned that thing. Also did you provided the Police certificate for yourself( i think you are the main applicant).

For work permit, you need not submit police certificate. Atleast, I didn't.

It says "be law-abiding and have no record of criminal activity (you may be asked to provide a Police Clearance Certificate),"
It says you may be... So initially while submitting your application you need not submit police certificate.

I wanted to know where did you mentioned that the application is for SOWP. As in form there is no option for SOWP

There is a question in Form IMM1295E "What type of work permit you are applying for"
Your spouse can selected "Open work permit" in the combo box.

most important documents to attach to his application is
your work permit + marriage certificate + your last 3 months payslips + your bank account last 3 months + if available reference letter from your company included (start date, duties, salary , number of hour per week), with all of these documents everything should be okay.

I suppose its only has to be on Company Letter head right and signed by any Company Authorized person either HR or my supervisor

I am applying for SOWP.

I have got my upfront medical done recently.

I intend to add the name of my husband on my passport in the spouse's name column in order to solidify the proof of my marriage along with the marriage certificate i provide.

Now this would change my passport id and when the application is submitted would conflict with my proof of identity given in the upfront medical exam.

Thus my question is would this create any problem or would they not consider this mild change as alarming as i fear.

Plz help its urgent.

Hi,

Before starting my query I just want to give a brief background of my status in Canada. Currently I am on my PG work permit which is expiring on November 4, 2015 but my PG work permit is extendable as it was issued according to my passport expiration. I also get my provisional nominee from Saskatchewan (SINP) on May 27, 2015 and I submit our (Me and my wife) application for permanent residence on June 4, 2015 and still waiting for File number and Medical.

On February 27, 2015 my wife have submit her application for SPOUSE OPEN WORK PERMIT on my post-graduate work permit. When my wife was submitting her application she went through an eligibility assessment by CIC in which it was mention that she can apply. According to Policy I should have NOC "A", "B" or "0" category job, which I have (NOC "B"), then they required work permit to be minimum of 6 month when you are applying, as at that time which was approximately 8 month work permit and remaining 4 month will be issued on my renewed passport.

After approximately 5 long months on July 22, 2015 she got a refusal from CIC with a reason that my work permit is expiring on November 4, 2015 and according to SOWP policy my work permit should be more than 6 months but at the time of application submission my work permit is more than 6 months and on other hand my work permit clearly state that it can be further extended.

I also submit my SINP nominee letter to them through case base inquiry but still it doesn't make any impact to her application.

Now I need some sort of guidance and advise for further process.
