Please let me know whether i can apply for PR in canada

Hi Folks,

I have a query regarding whether i can apply for PR in canada on after i have finished 1 year in working on Canada as Software Engineer

I came to canada on July 2012 and stayed till Jan 2013 (6 Months) with the closed worked permit (to a canadian company, was deputed to work here from the same company's indian branch).

Then i left to India on Jan 2013 and came back to canada on May 2013 again with the closed work permit again (for the same canadian company). This time, i hope to stay here till November end which will be 13 months of full time experience as software engineer. I have T4 Forms, and other pay slips are available with me for the above periods.

Please let me know whether i can apply for Canadian PR at the November 2013 after i complete my 1 year.(I know that i have to apply for IELTS, which iam planning to take up the test on september/october.

I heard that software engineering is not under the NOC occupations, (even if we apply, they will reject because of software developers). is that true? . Also whether the completion of 1 year in two parts (from Jul 2012 to Jan2013) and then (from May 2013 to Nov 2013) will be considered as an 1 year experience by CIC.

Hello Man

I think your case will be considered under Canadian workers stream and according to CIC you should have 24 months of Canadian experience. As long as I know, 12 months experience is only for PGWP holders only who finished 2 years Canadian education and 1 year of Canadian work experience provided "skilled work".

Seniors Correct me if I'm wrong.

Thanks for your reply!! Really, i am shattered to know that i am not eligible after 1 year. Is there any other class i can apply for PR in canada (like federal skilled worker).. Is this possible?

Firstly you would be eligible for CEC, did you apply for tax returns for the year 2012...if not do it asap.

good. the main document you need the reference letter from company later when you apply...

not a problem,, you need to have only 12 months of exp in the past 3 years.

Thanks a lot for taking your time and replying to my post.

While i was in india during the month of April, i applied the tax refund through taxback website, but still they have not given any update on the refund status. They gave me a waiting time of 12 to 16 weeks for tax refund. So I am waiting on that. Is there anyway i can apply newly for the tax refund.(i hope CIC will accept the tax refunds initiated from the third party vendors).

Sorry, I am not an expert on CRA thing... i know it will take minimum of 3 months when you apply for tax returns for the first time. All you need is NOA(notice of Assisment) from CRA for the yer 2012, NOA is also a major document in CEC application...


but i can advise you to call CRA (Canada revenue Agency 1-800-959-8281) and ask you query. I hope you will get some answer.

Rules changed this year. Only 12 months of work experience is now required for all applicants.
