Hi ,im from Philippines and i need an advice or help my common law partner file our family application this march 2018 with our kids but my son is not his biological son. i have annulment from court i have the custody with subject to visitation rights. and just today july 20, 2018 all the papers and requirements he send for processing was returned to him with indicated some notes regarding declaration of accompanying minor and missing identification of my ex husband. i hope someone could help me give some advice thank you so much.

In your sponsorship application the Principal Applicant must declare their dependent children (accompanying or non-accompanying to Canada).

For Minor Child(ren): if any child(ren) under 18) will be issued immigrant visa......If your sponsor is not the other legal parent of your child(ren), you must complete the Declaration from non-accompanying parent/guardian for minors immigration to Canada (IMM5604) form (http://www.cic.gc.ca/english/pdf/kits/forms/IMM5604E.pdf) for each child and submit a copy of an identity document for the parent who signed the declaration. The parent's signature must appear on the identity document. If you are divorced or separated, you must also include a copy of any related custody agreements demonstrating that the child is free to move to Canada.

Review and submit the forms and all supporting documents as required in the Common Law Partner Sponsorship Checklist

if this doesn't help......you may post section of the letter from IRCC to provide details and maybe others could help explain

Thank you for your response and regarding to the signature of the biological father of my son i really don’t know where or how could I find him anymore is there any other way or any supporting documents that I can provide for this imm5604? Thank you

If you are unable to provide documents showing that your child's other parent has no objection to your child's immigration, you must provide a detailed explanation. You do not need to submit this if your child is not accompanying you and will not be issued a visa.

In your detailed explanation, you must show proof to convince IRCC that you really don’t know where or can't find him anymore......may need to how you have made attempts to contact your ex-spouse.
