Hi guys

My husband who lives in NZ with me is a Canadian and NZ citizen. He is starting a new job in Canada early November. His company has told me they can bring me over on a visa which would take 3 weeks to proces but i would not be eligible to work. I would have thought i would be able to get on some sort of spouse visa to be elible to work, and that this would also get me to Canada in same time frame (3 or so weeks)?

Furthermore my employer has an office in canada and they have agreed to let me work there. If i were to agree, because the work permit would take 6-8 weeks, would i be able to go to Canada on a temp residents visa, then once the work permit is ready, leave Canada and reenter to register it at the border? I would like to accompany my husband to canada. Even if it means ill not be working while i have work permit pending with my employer in NZ for the office in Canada...

Thanks

You might get a better response in one of the "worker" categories of the forum, since this is not really a "family class" sponsorship you are talking about and people who read this area of the forum know less about work permits, if anything.

Also, a more specific subject line might attract the answer you want faster. You'll want to know if your
husband's application is a "temporary foreign worker" or "skilled worker" or whatever.

It's possible for a company to transfer you to a job in Canada with little or maybe even no paperwork (since you're visa exempt, I believe, as a NZ citizen), but such a transfer may be limited to managerial or supervisory job categories.

New Zealand is visa-exempt, so you don't have to apply for a temporary resident visa to come visit Canada. You apply for entry at a Canadian port of entry - with your husband with you, proving that you are legally married and that is intending to apply to sponsor you for permanent residence (required if you are intending to live in Canada), you should have no trouble getting in. They will probably document you on a Visitor Record that allows you to apply to extend your visitor status from within Canada when it's set to expire.

Your husband can start the sponsorship application process from outside Canada, being that he is a Canadian citizen, and the sooner the better. The two of you will need to submit this application, which will go first to the Case Processing Centre in Mississauga, ON for his assessment as a sponsor. He'll need to provide proof (his job offer) of his intent to return to Canada. After his sponsorship is approved (about 45 days) the application will be transferred to the embassy in Sydney for your assessment. They are currently finalizing spousal cases in 3-8 months. If you submit a complete, straight-forward application that includes her proof of medical and the criminal clearances, you can expect to be approved at the shorter end of that timeline.

Do be aware that if an interview is required (usually because someone doesn't include quality evidence of their "genuine" relationship) it will be held in Sydney - but a long term marriage like yours shouldn't need an interview. Don't let anyone talk you into applying "inland" for the work permit option either - it's not in your best interest ultimately. We can talk more about that later if you like.
