Hello,

I am new here. I desperately need help or advice from you if possible. My son's university graduation ceremony is coming soon in June and he wants both of us to be here in Canada. But because my husband never wanted to stay here since he landed in 2002, he didn't meet the requirements as a permanent resident and we all thought (of course, I consulted with a lawyer regarding his situation) he automatically lost his PR and his PR card expired in 2007. Last year we sent his expired card to Query Response Centre of Citizenship and Immigration Canada by mail with a letter expressing he did't want to be a PR. Three years ago I moved back to China and stayed with my husband.

Last month my husband submitted a temporary visa application in Canada Visa Application Centre in China, he was also required to fill out two other forms including IMM5538 and Consent to decision on Residency Obligation and Waiver of Appeal Rights. Two weeks later he was requested to submit the copies of his passport and my passport within five years according to the letter from Canadian Embassy. Another 8 days later he got a phone call from Beijing Canadian Embassy and was asked to fill out IMM 5524 because he was told he is still a PR since I have stayed with him for more than three years. So he did it. Last week he received his passport and a letter saying his file for a temporary visa is cancelled and he should submit Application for a Travel Document

I know the story is long. But can anybody advise us whether we should wait or re-apply? Thanks a lot.

Are you a canadian citizen? If so, if your husband has not yet relinquish his PR, he will still be a PR because there is a canadian spouse accompanying him outside Canada.

Since a PR cannot apply for temporary visa, one of the option is to get a travel document from a Canadian embassy. The other option is to get a US visa and enter Canada by road.

Thanks. Yes. I am a canadian citizen. So he submitted IMM5524 according to the phone request from the Embassy. But does his passport need to be visaed? Because his passport was sent back to him without visa. We don't know whether we should wait for the response from the Embassy regarding IMM5524.
