Hello guys,

My visitor extension was denied today. I was expecting that because my passport expired a couple of weeks after I submitted my application. The letter said I have to leave Canada immediately. is it possible to appeal this? Anybody has experience with something like those? I have no where to go with my daughter if I leave Canada, I’m not exaggerating:(
Did you get your new passport? This is essential to do anything.

If you did, then you need to now submit restoration of status: https://www.canada.ca/en/immigration-refugees-citizenship/corporate/publications-manuals/operational-bulletins-manuals/temporary-residents/visitors/restoration-status.html
90 days
  • Clients who have been refused an extension to their temporary resident status, and were in status (including implied status) until the refusal, have 90 days from the date of the refusal notice to apply for a restoration, if otherwise eligible.

Thank you for replying! The passport should arrive in the mail any day now. The letter doesn’t mention anything about restoration of status, it says I have to leave Canada immediately:( can I still submit my restoration?

What exactly does the letter say? Can you provide the full text? It may not be a simple refusal letter - it's possible it's a departure order. Based on what you've said - it should be a simple refusal - but you need to make sure.

Can you summarize your full history here?

Feb 2017 you arrived in Canada as a visitor - correct?

When did you apply for your first extension? Was that in October 2017 or earlier?

sure! here it is..

This letter refers to your application for a Visitor Record. Based on your application and accompanying documentation that you have provided, I have carefully considered all information and I am not satisfied that you meet the requirements of the Immigration and Refugee Protection Act and Regulations. Your application as requested is therefore refused. [X] Immigration Legislation requires that every foreign national in Canada must hold a valid passport, identity or travel document. As a foreign national in Canada, you have not produced evidence that you are in possession of such a document and that it is valid for the duration of your stay in Canada. [X] You are a person in Canada without legal status and as such are required to leave Canada immediately. If you do not leave Canada voluntarily, enforcement action may be taken against you.

Yes, i came feb 2017. Then i traveled to the states and when i came back the officer at the border gave me only until oct 31 because of my passport expiring soon. I then submitted the visitor extension.

ps. thank you for your help

I wonder if somebody can help here. I came to india on a visitor visa and allowed to be here for 6 months. To my wonder I met a lovely lady who I fall in love with and now we are living together. As we want to achieve common law period of one year I would have to apply for a visa extension hence if somebody can state if that is achievable ? What if I get denied and can't reach 365 day period ? What proofs are important during our stay as my address on my bank statement is of her house and we are planning to make it joint account soon. I want things to work in my situation and any suggestions will be much appreciated.

You can apply for an extension to try to become common-law. If you are unable to become common-law, you can get married. Look at the checklist to see what proof you need.
