How can i sponsor my girlfriend and our 3yrs old son in the philippines to come to canada.
Our situation is that my girlfriend is still currently married and her annulment is currently on going. Its been 3yrs and still no result.

Please advise if we qualify as a conjugal partner? Or what do we need to do.

Do we have a good chance as a common law partner.

What happens if we were to get married eventhough she is still currently married with someone else. Will they do a background check? Then again we want it to do it right.

We only spend a month together every year, and its so hard not to be with them. Due to our situation we dont know what to do.

You do not qualify as common law because you have not lived together in a conjugal relationship for 1 year and you certainly cannot marry her if she is already married. You will have to wait for the annulment before you can marry. Then you can apply.

if your son is yours (naturally) he already is Canadian he can come at any time. He wouldn't need sponsorship. All you have have to get him his Canadian passport. Hopefully you have previously registered his birth at the embassy as that would be your first step.

Yes, because you are not yet a citizen your son is not a citizen.

You have a chance at filing the application to sponsor them both under the conjugal partner section because she is already married in the Phillipines and unable to marry you, but that stream can be very difficult to prove and approval rate is quite low comparatively speaking. If you are able, I would spend a year living with her in the Phillipines (after you get your citizenship papers) and become common law and then you can come back to Canada and apply as common law, or as a citizen you could apply and remain in the Phillipines with them while you wait for the approval.

As soon as i get my citizenship how long is the process for getting my son to come to canada. Where do i start? As per my girlfriend all we can do is keep waiting for her annulment. But i am really hoping theres a way while we are waiting for the annulment.

We used an agency to help us with TRV but still got denied due to not satisfying the officer with strong ties in the philippines. Can we apply again? Is bad too keep applying.

You would need to be able to prove to CIC that you two are, in every way, like a married couple, except for the fact that you cannot marry. Do you support her financially? Show bank statements that prove this. Do you visit often? Show travel itineraries, photos from the trips. Do you have any insurance policies which list the two of you? Joint accounts of any type? You will need to be able to put together very good proof, going back as far as you can, that you two are in a real, marriage-like and on-going relationship.

Since the OP is not Canadian citizen and awaiting canadian citizenship, it appears that the son will not be Canadian either. The son can only be Canadian citizen if the OP was a naturalized Canadian at time of birth which the OP was not.

So the OP would also have to sponsor his son and gf for PR sponsorship and as PR he would be required to stay in Canada to submit PR sponsorship.

Yours sounds like a good case for a conjugal app. A 3+ years relationship with 3 yr old son together, could be enough of a "marriage like" relationship to satisfy CIC. As was mentioned, you'll also need to show how you are supporting your family financially.

CIC does not expect people in Philippines to wait for annulments since that process is incredibly long. She was denied TRV to come to Canada, and as far as I know it is illegal in Philippines for a married woman to live with another man, so that would also make common-law impossible.

As a PR you need to submit a conjugal app while you continue to reside in Canada. Your partner will be primary applicant, and your son a dependent. CIC will most likely want a DNA test done to prove the child is yours. After you get citizenship, you could then choose to reside in Philippines with your family while waiting for their PRs to be approved.

Yes i do support both of them i have all the receipt from western union. I visit once a year for one month, we do have a joint bank account in the philippines and yes both of them are my beneficiaries from my insurance. Will this be enough to satisfy cic... What kind of proof do i need to show.
