the PF letter will say one of the applicants is inadmissible and they'll list the reasons. the note says that it can be overcome so the PF letter will also give you the opportunity to overcome the issue before the final decision is made. there are similar cases in this forum

Yeah think SpoonRaccoon is right. They will probably tell you to apply for rehabilitation. Yeah the time would have been up in december 2014 but i have read somewhere on here or on another forum someone had a DUI but it was 13 years and they still made them apply for rehabilitation. guess they just make up the rules sometimes. You should call ASAP though because they usually only give you 30 days to reply to a PF letter.

Yeah going to call this morning and we have never received anything from them about this that's what worries me as the note was dates 25 March in the GCMS notes that's almost 3 months ago !!

Try not to panic. I think they ask for the rehabilitation application anyway, even if the time has elapsed. A friend of mine went through the same thing - her husband got a DUI in 2008 in S. Korea. They were asked to complete a rehabilitation application and submit additional evidence like court records, etc and they now have PR.
If you are in Canada, you may want to call the CIC call centre and ask them to confirm when this letter/email was sent and also mention you haven't received it. They should be able to pass this along to the visa office. Keep us posted.

Thanks ! We called yesterday and they said the letter had never been sent it was an oversight on their part , so said they would send it out right away , we got it in an email this morning ,so have lot work to do next couple days getting things together !! more hoops even thought their website says you should be deemed rehabilitated after 27 years have past I would think so but no ! And the DUI is over 10 years ago as well just don't get it !! It's says after 10 years you should not require a rehabilitation order ! Also will be going to a lawyer for some advice as this step of the process must be done right or it will get refused

I tell you something, its a good thing you ordered the GCMS notes, you wouldn't have known all this. I always order my notes every month in order to keep me abreast on my file.

By the way,, Did GCMS notes tells anything about Ip? As you said You got IP 3 months ago, but In GCMS notes, did they mention somewhere that " they started Processing YOur Application" I mean your status is IP now...

Hi Carol, Could you please let me know whether you declared about your husband DUI in your application or not?? And is the outcome from lawyer whom younmet is a positive or not??

Hi yes we did declare it and the lawyer seems to think all will be well we just have to get the rehabilitation order as requested by CIC , so our case will drag on for a further few months until all this is sorted out rehabilitation orders can take months to process . but don't have an option right now he said we could fight it as its over 10 years but he said that could take longer than to process the rehab application so just go with what they want for now . :mad: :mad:
