Please help sponsorship within Canada

Hi,
I am a Canadian Citizen and my husband is a British Citizen. We are currently living in UK and now planning to move to Canada. I'd like to sponsor him within Canada but would like to know what are the main requirements for spouse sponsorship. As when we move over there we are going to live with my parents until he receive PR. I am trying to find a work in Canada from UK but haven't found yet.

Can I apply for his sponsorship as soon as I enter in Canada? With my application I am going to submit work permit request for my husband. If I don't find a work for my self during application process, will that give negative decision on my sponsorship application? Please some one reply and also let me know how long it is going to take to receive approval for PR and get work permit.

There is no income requirement for sponsoring a spouse but CIC will want to know how you will support your husband. You can apply as soon as you enter Canada but expect it to take around 11 months before there is a decision on his work permit. Processing times for inland applications currently stand at 19 months.

It sounds like in your case, it would be better to apply outland for PR through the London visa office. For a basic straightforward application, you could most likely have full PR outland, quicker than it takes to get just stage 1 of inland. You could send the PR app while currently living in the UK.

During the processing time it should be no problem for him to travel to and stay in Canada as a visa-exempt visitor.

Can I apply Outland application within Canada and give our Canadian address? With that application, could we submit work permit as well?

I do not want to risk applying outland and entering Canada to be reject his entry as we have 7 month old baby.

You can do the medical wherever you want to.

No - no work permit is granted with the outland application route (only inland).

Yes - you can give your Canadian address.

Regardless of how and when you apply, there is never a 100% guarantee your husband will be allowed to enter Canada. This decision is up to the immigration officer he encounters at the border. He should have no issues entering Canada since he's from the UK - but there's always some chance of refusal no matter how small. If you want to avoid this risk completely, then you can apply for PR using the outland method while still living in the UK and only move to Canada once his PR visa has been approved.

The medical would be done in advance, and submitted along with your application. You could do this in the UK.

No OWP associated with outland apps. However as i mentioned, with a straightforward case (like being married with a child), there is a very high chance your husbands entire PR application will be approved quicker than the time it would take to get just stage 1 approval and OWP with an inland application.

As scylla mentioned, there is never an absolute guarantee to enter Canada. However even if you wanted to apply inland he needs to get to Canada first... and that will involve your husband coming to Canada as a visitor and going through an immigration officer.
In practically all cases there is no problem whatsoever for a visa-exempt UK citizen to enter Canada as a tourist for a 6-month stay. Just have a return ticket to show dated just under 6 months later, and never use the words "moving" or "living" when talking to the officer... just visiting or travelling. When the 6-months is almost up, again it's usually a fairly simple process to extend the visitor status another 6 months.

If I apply within Canada how long will it take to receive it because for her immunization shot at 12 month before that I need to take her Ontario Health Card. If I explain this on cover letter with her application forum will that processing time expedite.

After I enter in Canada how do I get her Ontario health card without proof of citizenship.

I'm not sure time it takes to get citizenship documents.

Keep in mind as a returning Canadian citizen, you will not be covered under OHIP for 3 months after arriving back in Canada.

Your daughter will not be covered for 3 months also at least, plus if it takes more time to get her citizenship info.

Your husband will not be covered until his PR is completed, plus an additional 3 months after that.

So you should plan to have private emergency health insurance for all of you, for the timeframe you won't be covered.

If I have her temporary Canadian Passport. Still she won't be covered with OHIP? Even if I proof that I've applied to get her citizenship certificate. Please let me know.

Another thing to consider when coming before P.R. is granted , and bringing contents of household items, other than your suitcases you will be subject to taxes . If you wait till you have his P.R. he will be tax exempt. Also Medicals are half the price here in Canada than in the U.k.

Thank you so much. I've contacted Canadian embassy in London regarding my daughter citizenship, told it will take nearly 15 months to process :(

Is anyone knows that after entering in Canada with my daughter (british passport holder) how to register for OHIP and other things in Canada.

I wouldn't take their word that it would take 15 month to process proof of citizenship. When I applied for proof of citizenship at the time, it stated 12 months to process. When in fact the children got theirs within 3 months of application.

Don't let the long timeline for proof of citizenship fool you. Apply as soon as possible.

I think the length of time to get proof of citizenship are meant for those who are already Canadian. For example I'm canadian by birth but I wanted proof of citizenship so I have other form of IDs to use besides Canadian passport, birth certificate. It took me the max time to get certificate , 12 months.

Whereas the children, they needed their proof. No other ways to prove citizenship so they got theirs in 3 months. Higher priority seems to be given to children born canadian wihout proof.

As for OHIP, I am not sure if they will accept Temp Canadian passport as proof of Canadian citizenship to qualify for OHIP. You may have to go to Ontario service cente as explain your situation to see if they will accept it. If they do accept it, unless the baby is less than 7 months old, the baby will have to wait 3 months before getting on OHIP.

I know this because when I applied my 2 children, 6 months and 1.5 years old, the 6 months old got OHIP right away. The 1.5 year old along with me, had to wait 3 months before getting OHIP.

Is that mean I've to apply for health card after getting her proof of citizenship or would I able to apply with her British Passport with my Canadian citizenship.
