Please Help - Regarding Immigrating to Canada from the US

Both me and my wife are on H1B in the US. We want to apply for our Canadian immigration now.

Question is -

After getting the immigration (PR), will it be possible for us to continue with our Job in the US? or is it mandatory that we must leave everything behind and settle down in Canada?

I have asked a lot of people about this, but didn't get a proper answer. Any help regarding this will be highly appreciated !!

You can still continue to work in the US with your H1-B visa even after you acquired your PR in Canada. I think the problem will arise when your PR in Canada expires assuming you successfully apply for it. I'm not sure of the exact number of years but you need to prove that you have lived physically in Canada for X no. of yrs. to be able to renew your PR.

I think it's a good plan to apply for PR in Canada while having an H1-B visa in US. The disadvantage of having an H1-B visa in the US is you can only work on the company that sponsor your visa while being an immigrant in Canada, you have the freedom on where you want to work. Also, consider the present economy in the US we're layoff occurs once in a while, it's not easy to find a company that is willing to transfer an H1-B visa.

Can anyone tell me how long it takes for the regular process of canada PR under skilled worker.

I am in usa and looking for job in unix administration and planning candian PR to apply as soon as possible.

I need to know how to get police certificate in india , sweden (lived 2 years) and in usa (almost 3 year)

I born and raised in India. do we need to take IELTS.

I have a family (wife GC, 1st kid GC and new born us citizen and I am on h1b visa still). I want to apply canada PR only for me. is it good idea as all the IT consulting company are not helping to file green card for me.

Can anyone give some information.

Hi, the processing time seems to be between 16-25 month from Buffalo.

I don't know how to get police records from India, but for Sweden, visit http://www.polisen.se/inter/nodeid=37023&pageversion=1.jsp it will tell you everything you need to know. You'll have it within 2 weeks. You will need to have your Personal ID Number (YYMMDD + the last four digits).

For US (FBI) you need to download a fingerprint card from FBI.gov, get fingerprinted and send FBI your fingerprints and a check. All instructions are available at FBI.gov

here's a quote from the CIC website:
"...To keep your status as a permanent resident, you must live in Canada for at least two years within a five-year period... you must have been physically present in Canada for a minimum of 730 days within the past 5 years..."

So, you can still keep working in the US, but to fulfill this requirement, you will eventually have to move to Canada and live there for 730days...

3) you may be required to take IELTS if you cannot prove that English is your 1st and native language and only language spoken at home...

4) If you apply for only yourself, make sure you list your wife and kids on your application so that later, if you decide to file for them, there will be no issue. Since your wife is on GC now, hopefully she gets her US citizenship soon and will be able to apply for you to get your US GC...

Now will this be possible ... ?

1. We get the PR.
2. We go to Canada for a week or so.
3. Come back to the US ..
4. Work for 3 years
5 Go back to Canada - and work for 2 years.

Your plan should work. Like what other poster said, if you live physically for 2 out of 5 years in Canada, you can maintain your PR status in Canada.

But if you get PR in Canada the best would be to do the following:

While working in the US start applying for jobs in Canada. When one of you gets a job then pack up and move the hell out of here. As it is the US is getting worse by the day. I am afraid that as things deteriorate in the US that many, many more Americans will be heading north, and then Canada may get much more restrictive. (At my work place that is a daily topic of conversation, and some are already proactively doing research to move.)

Immigration rules change at the drop of a hat. Remember that. So, unless you are pretty sure about getting PR (one of the toughest things to do in the world) in the US, get while the getting is good!
