Hi guys,

due to refusal of LMO I had to go back home. I plan to apply for IEC 2013 under Young Professionals (I have a job offer), and after 12 months apply for CEC.
...
My question is - If I get a work permit valid for 1 year, it is impossible that I start working on the very same day of landing, so I will lack a few days to complete 12 months.
Depends on "how recently" you went home and whether your previous experience was "skilled" (i guess I'm assuming you worked in Canada before). You would need 12 full months of skilled employment within 36 months of the date of your application. So if any of your previous experience were skilled and still fell within the 36 month window (by the time you complete your additional 1 year), then you could add that.

Otherwise, you would have to find a way to get a new work permit.

Please provide a source of this because it makes zero sense. if you only work 30 hours/week, it cannot be counted as full-time. I've never heard of working 6 hours a day from M-F being counted as full-time.
johnny123 has already provided the link to the Gazette indicating this as one of the planned changes.

Just FYI, this makes a LOT of sense because different provinces have different definitions of "full-time". For example, in Ontario, full-time is defined as 30 hours or more per week. Because I live and work in Ontario, my contract (regardless of the number of hours I actually work) states that I am a full-time employee and work "at least 33.25 hours per week". Under the old CIC definition, this meant that I was classified as part-time by CIC and had to count hours... as did all the visa officers evaluating applications. Reducing the number of hours in the definition of "full-time" will harmonize the requirements with provincial standards and simplify the processing of applications for VOs.

He has provided the link after my first comment so I saw the changes already.

The reason why I thought it made no sense was because I run my company and because of this upcoming rule, many of my workers will be considered "full-time" and that changes a lot for me when it comes to dental benefits and bonuses.

Guess I'm going to make some changes as well next year.

This change is for immigration purposes only. It is not a change in Federal Labor Law. :) In any case, I believe that the things you discuss are subject to provincial rules, and this won't change them -

Yeah, I was going to make a few calls this afternoon to get more info. Glad to know, you just saved a few folks their jobs b.c I'm not going to take in an additional 5-6 full-time people when I have dozen already. They owe you one b.c I pull fast triggers when it comes to people staying or leaving!

johnny123,

"The Minister also announced changes to how the working holiday category is structured. Currently, Irish citizens can participate twice in the IEC for a maximum of 12 months each time. Beginning in 2013, Irish youth will be eligible to participate in the IEC only once but for a period of up to two years. The change will eliminate the need for people, who are already residing and working in Canada, to disrupt their employment and leave the country in order to apply again."

The above information is given in CIC site News Releases for 5th Oct.
Thanks for the quote roger :)

That's a good point! Unfortunately due to my poor knowledge in the 1st year of employment, I hadn't been on payroll

As you said, this is for immigration purpose only.

Guys, let's not mix up full-time and full-time equivalent: full-time equivalent is defined as 30 hours per week, BUT for immigration purpose full-time equivalent is defined as 37.5 hrs/w. After New Year they will match both - for immigration purpose full-time equivalent will be defined as 30 hours per week as well.

What does that change?

Well, it changes the fact that people who work between 30 and 37.5 hours per week will be available to apply under CEC after 12 months (they don't need to count hours), otherwise they will be considered as part-timers and will have to count hours. For example, if someone will work 25 hrs per week, they will be available to apply after 62.4 weeks (instead of 52).
