I left everything behind and moved to canada at 19 to be with my spouse. We havent even been married 2 years.Everything seemed to be going good we never had a fight, rarely argued, tried to do fun stuff together, told each other I love you all the time. A couple weeks ago he told me he doesnt love me anymore :( and that he wants to break up. I cant believe he would do this to me. I just started university in january and just got my PR in August 2015. I am so heart broken. I would get if we argued everyday and hated each other but it wasnt like that at all!

I have no idea what to do, i cannot just go back home. I cannot stay in this appartment with him either. I lost my job because i could barely do anything except cry. I am so depressed and hurt :( to the point i dont know if life is worth living.

So my questions are how long can I legally stay in Canada? Does conditon 51 still apply?

August 2016* for the PR

You can stay in Canada indefinitely, unless you are subject to Condition 51 AND IRCC decide to investigate. Your spouse is still responsible for you for the remaining balance of the sponsorship undertaking. There is nothing that you need to do at this point from an immigration aspect.

Unless he reports the relationship breakdown to IRCC or they do an investigation, you should be able to stay until the condition expires (if you have it).

Sorry you have to go through this. I hope you don't receive any hassles from IRCC. If you have not much support here from family or friends, maybe your university has counsellors you can go see about your breakup.

Good luck to you!

Thank you :(

But if i fill out government forms like taxes and financial aid wont they see that the address is different? I just looked and i have condition 51. Will they report that to immigration? And if we get a divorce will that be reported to immigration too? I have no idea what i am going to do.

And when i have to renew my PR card, wont they see that as well?

Conditional status of PR is automatically removed exactly 2 years after getting PR status. So in your case would be Aug 2018. After this point, as long as no investigation was already started into conditional PR rule then you would be assured of keeping your PR status forever. Anything that happens after the 2 year point is irrelevant, so would be zero risk to renew PR card in 5 years time.

Is Condition 51 based on the date the person landed, or the date that the couple were married? As I recall, Condition 51 does not apply to couples who were already married more than 2 years.

Regardless of Condition 51, the sponsor would be responsible for you for the entire 3 year term. Since you are going to school, and now jobless, your husband might see that as a risk that he is not willing to take. If this is unusual and unexpected behavior, is it possible that your husband is deliberately pushing you away to save you from something? Is he perhaps sick? Or maybe got involved in something that might put you in danger?

Best of luck to you.

There is also a good chance that Condition 51 might be repealed later this spring, and it would be retroactive. This was something started by the previous immigration minister, but the current minister is looking at getting rid of a lot of other conditions.

The 2 years starts at the date of landing.

As far As I remember, condition 51 does not apply if couple are married for at least 2 years at the time of submitting sponsorship application.

Correct, or have a child between them before submitting the application. IRCC have made mistakes however, so you need to double check that the COPR has the correct condition set.

Other government agencies don't know about your Condition 51 and they will not report it to immigration . and they are not going to compare your address to your sponsor's .

The IRCC is too busy with criminals to care about your condition 51. The CRA doesn't share information with IRCC. If they did, none of us would need to submit Option C/Notice of Assesments.

They only have access if you default on an immigration loan, or the person you sponsor goes on social assistance. They won't be reporting your marital status.

Now the CBSA on the other hand, might hassle you because that's what they do, so I'd suggest not travelling until your Condition 51 is up or it is cancelled by the government.
