I am a TFW in Canada since 2009. I am now waiting for my new work permit with a new employer, and I worked with two different employers since 2009. My concern is about the first employment I had which was from 2009-2010 and the future, and a plan of migrating in Canada. I was given an LMO and told to get a work permit so I can work asap, but the employer told me I will be working at his sister's store instead of his. I got the work permit and immediately started working. His sister pays me and sends me the pay stud through email with her business name to it. I worked there for a year and she gave me 2 T4's for 2009 and 2010. I used those T4's for tax filing. After that I worked with a new employer for 2 years with work permit also.
My wife and I are planning to apply under FSWP, with my wife as the principal applicant. As the spouse working in Canada, I read the requirements that I should provide. I asked my 2 previous employer for Certificate of Employment and reference letter. The second employer provided me with both, but the first didn't because he said I did not worked for him but for his sister. Since it was my first job here in Canada, I thought everything was ok. He told me that for a year I spent working with his sister's store, I've been illegally working. I realized the discrepancy and wondered how will it affect our plan of applying to be permanent residents of Canada under FSWP.
As the spouse working in Canada, I am required to submit employment authorizations (work permit and contract maybe), T4's, and letter of reference from employers. A form also requires me to fill-out all my activities for the past 10 years.
Please help me. I don't know what I should do.
Thank you!
