Hello

My husband and I are doing inland application (we applied in Nov of 2011), my husband was here as a visitor we had to extend his stay in Canada he got a visa which was valid till June 2012 in a mean time my husbands brother has died in April of 2012 so he left Canada ...he is still there ...i didn't contact immigration to let them know he is gone....i went to visit him there ...now i would like him to come back... we finally got AIP...but in the letter says (i guess they still think he is here) that he needs to apply for "application to change conditions, extend my stay or remain in Canada"...and it says that needs to sent before September 18....so im not really sure on what to do .... my husband is coming back to Canada October 03....my husband and I been through so much in these few months... bad thing after another...please help us
 
should i just call cic and tell them he is out of the country... and that extending his stay doesn't apply to him?...
 
Since he is outside the country, his past status no longer matters. What matters now that he has AIP is him coming back into Canada to be present at his landing appointment. If he is not present for that appointment, his application will be deemed abandoned.
 
i sent him all the AIP papers... just in case if the they ask when he comes in...im thinking he should come in saying he coming to see a friend... not mentioning PR application in process or a spouse.. only answer if they ask...
 
No. His information is already entered in FOSS, and the officers at the airport likely have access to it, he should NOT misrepresent himself. Instead, if asked, he should explain why he had to leave Canada and present his AIP papers.
 
when they scan your passport ...would all show? i been reading a lot of people had no problem getting back in the country....so hopefully my husband wont have problems.... i called cic today...told them he is out of the country...a guy said restoration of status doesn't apply to him then ...i asked would be able to re-enter ...he said all depends boarder officer... so pray for us...
 
The manuals actually discourage CBSA officers from refusing him re-entry. It isn't prohibited, just discouraged. If there were some other reason to refuse entry to him (removal order, criminal inadmissibility issue, etc.) then they would be justified in refusing him. But just because he went home? It's within their discretion, but someone would really have to be in a very bad mood to do that.
 
I would also advise him to bring a copy of his brother death certificate, along with his other paperwork just in case he is asked why he left. As others have mentioned, it is at the CBSA's discretion and if they are in a bad mood then maybe real proof that there was a legitimate reason for leaving will sway them to allow him to re-enter.
