Please help me with my issue, Open Work Permit

Hey guys please help me with my issue.
I applied my student visa back in July and they granted it. After i got my student permit, my husband applied for open work permit and until today is still in process. Originally, My first class started in sept but i had to change my program to January 2023 because my past program didn’t offer any online classes and we are still waiting for my husband’s visa. After i got my new LOA and stuff i haven’t updated anything to ircc. Now ircc sent me an email regarding my husband’s visa. They asked me to provide a proof that i am a full time student since i haven’t updated my new LOA yet. Is it dangerous? Please help me

They want to see that you are attending school since your permit was for the September program. You need to inform IRCC ASAP with the deferral. Is it the same school? Why do you want online classes? How much of the program is online?

Yes i only change my program of study, but it is still in the same school. I want to go to Canada with my husband, and since he hasn’t gotten any visa yet i tried to reach my academic adviser about taking online classes while i’m waiting for my husband visa. Sadly the past program required in-person classes that’s why i had to change my program of study. Now Ircc asking for additional document regarding my study. I’m currently writing an explanation letter about why i change my program and stuff and want to update my new LOA to ircc. Do you think they will approve my husband visa?

You should start your study in the Sep. intake. Now, this shows that your primary intention is not study. You are more interested in the husband work permit. Good Luck|

Hey thank you for the response.
Actually is not like that. We are newlyweds, i hope i can go to Canada with my husband instead go alone. If he got refused ( i’m praying he wont) i have no choice to go by myself.

You now have a permit based on studies beginning in September and you failed to notify IRCC. It is October and your September program started weeks ago. You must update your file with new LOA ASAP. You can include an explanation letter but given processing times and length of time for webforms to be processed to update your file, prepare that the SOWP will not be replied to by January. Will it impact your husband’s SOWP, it is possible. If you are doing a Masters or PhD, then you are likely to be approved. If he is refused, you then go alone.

If I understood correctly, you changed your original program of study within the same school. I won't get into much detail but you might've just put yourself in a complicated situation. First of all, you haven't received a SP... you received an initial approval and your SP will be issued once the immigration officer at the port of entry reviews all of your documents. Second, your application was approved for the program you told IRCC you were studying... If you changed programs after the Letter of Introduction was issued by IRCC, then you must submit a new SP application. Search the forum and you will find a lot of information about changing programs before starting studying. Long story short, it's a no no.

If you are waiting for your husband OWP application to be initially approved, then the best you could do is to request a change back to your original program for Jan or May intake and submit that LOA to IRCC. If you inform them of a different program, they might cancel your Visa and tell you to submit a new application or to submit additional documents which could take a long time to be reviewed. Not to sound harsh but it seems you did not research enough about your options and possible consequences. Good luck!

Second, your application was approved for the program you told IRCC you were studying... I try to do it because I've read about a lot of people having their application turn into a nightmare because of not doing the due diligence prior to changing programs or making decisions that might ultimately, end up hurting them. Hopefully, some people read this and avoid making uninformed decisions. Dealing with IRCC is hard as it is.

Hello, thanks for the response.
I had to change my program cz my original program only open once a year i can’t wait for a year that’s why i changed it. I don’t really know what to do now

Actually this is a very messy situation.your best option is to get back to the initial program for which ur study permit was approved be it in sept 2023.according to ircc u cannot change program before even entering canada.after entering canada its a different story.take deferrel to the sept 2023 intake n submit that loa ..there is a chance of revoking otherwise

According to IRCC, they once tweeted that if you are changing program but same school you don’t need to tell us. It was on IRCC official twitter so i’m trying to reach them. I hope i can get an answer.

Before you change your school or program, you must meet all the conditions of your study permit. This means you must be:

This means that in order to qualify to change program, you must be ACTIVELY STUDYING IN CANADA, which you are not.

Your old school will report you as not being registered to study. If this happens:
  • you’re breaking the conditions of your study permit
  • you may be asked to leave the country
  • this may prevent you from coming to Canada in the future
    • For example, you may not be approved for another study or work permit in the future.
Changing your DLI if you’re outside Canada
If you change your DLI before coming to Canada and you don’t let us know, you won’t be allowed to board your flight.

If your application has been approved
If your application for a study permit has been approved and you change your DLI, you must submit a new study permit application with a new letter of acceptance. You must also pay all the fees for the new application.

OP isn't changing DLIs, just programs. Above is for changing DLIs.
