Please Help me its Urgent

Hi Everyone ,

Please help me , if you can.
I have refused from spousal sponsorship visa , because CHC ISLAMABAD asked to me to send documents and some forms , that i provided to my lawyer but my lawyer carelessly dealt my case and ALL my documents did not received to CHC islamabad .So refused , then my husband did appeal one year ago .
Now,

My Husband have received a letter from IAD a week ago ,which states that
".........., As part of processing, the IAD wishes to identify the important issues in each at an early stage , and encourage the appealent and the Minister's Counsel to resolve or settle without having full hearing . Therefore we are requesting that you explain in detail , why foreign national was failed to provide documents and inform the IAD as to whether the foreign national whom you have sponsored will provide the requested documentation to the visa officer as stated in refusal letter from Islamabad . If foreign national agrees to comply with this requirement , the visa officer may reopen your file and continue the examination of your sponsorship application "

what s that mean of the above note ?
should i just have to explain reason or also i have to submit all documents with this explanation that CHC did not receive before ? I am little confuse in it.

I think your lawyer hasn't supplied the necessary information that they requested and they are asking you why this was. I would find out what information they are looking for and write an explanation about why this wasnt included in the original application. It seems to suggest that if you do this and they accept the explanation they will reopen your husbands file for processing.

Maybe someone with more knowledge of the Islamabad office will be able to help you out a bit more.

to my understanding I think they want you and the minister to try to come at an agreement , that You find ways to solve the issue amicably. So they want you to say why the applicant failed to submit the documents and if they are willing to submit any document that is requested . So you write letter stating why he failed to submit it and then assure them it ready now and you are willing to comply . If the minister agrees then it will be sent for furthering processing , if not then it will be contested before the judges to determine the way forward . So try to see if you can get an out of court settlement first . Am not a lawyer but that's what I make of the above letter. Plz note I may be wrong or right .some lawyers can be annoying , they charge so much yet fail to deliver . Try to seek advice only and gather documents etc when it comes to mailing a document take charge and make sure it sent . Depending on someone to mail something on your behalf may not be a good idea . The lawyer has nothing to loose but you so take charge and handle those aspects yourself . All the best and Gud luck.

Your husband has to explain what happened, and if possible you need to get a letter from your lawyer in stating that he received the documents,
but were not sent, and maybe apologizing for the situation, if he is a gentleman he should bear responsibility.

I am gonna submit my courier receipt and an Affidavit from my lawyer with the explanation , according to him he sent my documents but he didn't provide me any courier receipt as a proof . He is no more my representer.

I got an Affiadavit from my lawyer that he sent my documents , because he said, he sent my documents. I have attached my courier receipt and his Affidavit .

usually if your case doesn't have red flags you don't need them even , and be calm about it don't argue with them too much , just explain saying there might be delays on the part of the courier etc and apologies . In some cases your email get delivered to spam do it takes a while to see it , so by the time you gather the documents etc some days are already gone . The minister should understand. Tc

Good to hear that you are no longer dealing with the lawyer, as everyone said, gather all the docs that were requested earlier and give an explanation that should do it.
