Please HELP !! IMPLIED Status. LMIA Negative response recieved

Hi Guys,

Please advise me here. I am in big trouble.

My Current status is Implied (Worker). My work permit expired on 7th of November 2016, and LMIA from my employer was in processing at that time. So, I applied for my work permit extension on November 3rd 2016 on grounds that LMIA is in-progress, and as soon as LMIA comes through I would send that letter to CIC.

Few days back, Service canada sent negative response on LMIA. I am confused what to do next. What are my options ?

I am still working under implied status, as result is still pending from my CIC work permit extension application.

Can I apply for Study Permit for Jan intake while I am on implied status ? When I apply for study permit, would i be allowed to continue to work ?

Or

Should i wait for decision(Refusal) on work permit extension and then apply for study or visit as restoration ?

You have implied status until the decision for your work permit is received. Once the work permit is refused, you will need to stop working immediately.

Sure, you can try to apply for a study permit. However I'm not sure this is a realistic plan given it's already December and you most likely don't have enough time for the study permit to be approved for January.

Thanks for replying. so do you suggest i should go for May College intake and wait for wp rejection ?

I am worried would i get the time to restore my status or not on wp rejection or I have to apply for visit or study visa with 90 days from the expiry of my last work permit (from 7th November).

Hello, I just had the exact same thing happen to me recently! You can continue to work while the WP extension is being processed, it takes exactly 3 months. Mine was denied based off my negative LMIA result so likely yours will be the same. They didn't even give me a day, literally said my work and residency status was gone on the day I received the letter so be prepared! As far as the study permit goes I wouldn't have a clue, Luckily my company done a second LMIA application. Do you think your company would do it again? They can get the application processing expedited and only takes around 10 days

When you say they didn't give you a single day, does that mean your implied status expired on the day refusal correct ? And you would get 90 day restoration period.

My Employer has agreed to do another LMIA though.
