I am Canadian born,

Ill keep this story short.

Was with the wrong crowd , doing wrong things, Have a history of arrests , etc. I fled Canada to avoid being put in Jail. Jail does not rehabilitate anyone, i had to leave to save myself.

Its been about 4 years .

Can having a criminal record effect me being able to sponsor my wife ? I am with her in an Asian country.
 
The CIC sponsorship guide states that you may not be an eligible sponsor if:

You were convicted of a violent criminal offence, any offence against a relative or any sexual offence—depending on circumstances such as the nature of the offence, how long ago it occurred and whether a pardon was issued.

If you left Canada because of pending charges...wouldn't these charges come into effect when you tried to land in Canada? To sponsor a spouse, when you are outside the country, you need to show your plans to re-settle in Canada once the application has been approved.

Criminality for sponsors isn't as big an issue it seems than for applicants.

Question 16, Section E of the Application to Sponsor and Undertaking asks:

"Have you been charged with an offence under an Act of Parliament punishable by a maximum term of imprisonment of at least 10 years?"

The issue is you fled Canada and you would have to see how that would impact you on your return.

Best recommendation is to consult a lawyer.
 
Thanks for the replies, I did consult my lawyer he said he will look into it.
But i want to sponsor her before i come back, so i can land with her. That is what i want to do.
 
Well if you fled the country to avoid a jail sentence, if you return you will probably end up serving that jail sentence, and then some. I don't think there is any option for you to be a sponsor while living outside of Canada, so you will have to weigh things up in your head whether it is worth it to go back to Canada to serve your jail time or not. Personally I would do it.
