Hello Everyone I'm new in this Forum! I was just looking for some information and this forum appeared, it has been so helpful in my process.

This is my situation: I'm originally from Mexico, have been living in Canada for more that 2 years, I applied for PR under Skilled Worker and I just withdrawn it because I could not get 1 document they required me, I chose to do it rather than get it refused. I have still a work permit. Now I'm turning in august into a Common Law relationship after 1 year of living together and sharing everything which we can prove, with credit cards together, wills, health benefits, bank statements, and insurance my partner and I have decided to apply for my permanent resident being sponsored by him, we don't know what is the best option, We would like to remain together and even he can support me, I would like to be working. Can I submit an out land application while I remain working in Canada??? Does it matter that we submit the application right after we become common law??? I'm just afraid we can be separated for some reason, I'm from Mexico and now I need a visa to enter Canada.

If somebody can advice I will appreciate it, I can provide more details.

Thank you all!

Check processing time for Mexico; if your work permit time would cover processing time I would go outland. Inland process takes much longer, usually it would take several months to get a first stage (sponsor) approval- this is when you'll get a work permit. For Outland process you'll be able to work only after the whole process finalized. Sorry if it's not very helpful- not familiar with inland proces...
And yes, you can send your application right away as soon as it's 1 year you are living together

You can see at http://www.cic.gc.ca/english/information/times/international/05-fc-spouses.asp#west that the processing times in Mexico average about 7 months and before that, Mississauga has taken about a month to approve your husband as your sponsor so about 8 months, could be faster, could be slower. If you can't make that before your work permit expires, you can see if you can extend your work permit. If you can't extend your work permit, you can apply to change your status to visitor while you wait but if you do that you would not be able to work.

If you apply inland instead of outland, you could have first stage approval in 6-7 months if all goes well and then you would be able to get an open work permit.

Thank you very much guys! Both options are good for me, I just need to decide for one. I would like to apply inland because if I get aprove in the first stage I can get an owp which is what I most need now (I hate my job) but at the same if something goes wrong it could be delayed for months or even years right?
I have another question. My relationship is so short, only 1 year we met, and after 1 month we moved In together, now in August we have 1 year cohabiting the same place and sharing everything, he is adding me to his health benefits, pension beneficiary and will, I have him. As beneficiary in my life insurance and we share credit card,we live like a married couple. Do you think that the short time could be a red flag for the CIC?

Thank you very much for answering back!

Yeah, it might be. The visa officer will most likely question it, but if you can prove you have been living together for a year, and that your relationship is genuine, it should still be OK.
It sounds like you have good proof of a genuine relationship. But are both your names on the lease, and both since last August?

We did not get a lease, my partner owned the place before I met him, we I have been helping with the mortgages and utilities since August 2009 would that be enough! He got monthly checks from me since last year, we also got a credit card 1 month ago to cover all the grocerys and more expenses! We have bought appliances like TV, blue Ray, travel a lot together, I met his family and also we bought a dog too! What do you think? Thanks for replying

All these things are good evidence that your relationship is genuine. But for common-law applications, you have to prove you have been living together for one year before the application, so if the checks from you start in August 2009 and are clearly for the mortgage and utilities, you can apply in August 2010. But if the checks don't start then, I would wait until a year from when they did start.
