I hoping someone can clarify for me. I was recently found inadmissible to Canada for working here when I shouldn't have (ironically I was going through the border to obtain a work permit which for some reason was never preapproved, they seem to have no record of my application despite taking $350 from me) and have been given 15 days to leave on an IMM 1282 Allowed to Leave Canada, which just means I will withdraw my application to enter Canada and voluntarily go home to Ireland. The officer that issued me with this said I can't apply for another work permit for 6 months, however I cannot find any information on this anywhere and would appreciate any input as to what my best move is, I would like to return asap. Also am I likely to be let in as a visitor providing I can prove I'll will return home; Return flight, proof of address, employment e.t.c.

Who took $350 from you? The process of getting a work permit is like this: The employer must advertise the job for a certain amount of time. He must be offering market wage. If he gets no takers or nobody who is qualified, he can apply for an LMO. If Service Canada agrees, he gets the LMO saying he can hire you. Then you can use the LMO to apply for a work permit. If you are in Canada, it is best to go to the border where you get it instantly. The work permit would state which employer and which position. You are not allowed to start working until you have the work permit.

If you have now been caught working illegally, I suggest you return home as you were told. Get your employer to apply for an LMO the proper way (this will probably take a couple of months) and then you can apply for a work permit from Ireland. I do not know either if there is a 6 month rule but if you apply for a work permit within 6 months, I am sure you will find out.

Immigration probably has you flagged in their computers now so if you try to return as a visitor within 6 months having a history of working illegally, they may deny you entry.

I can confirm there is a six month rule. Since you were caught working illegally, you cannot apply for another work permit for a six month period.

You can certainly try visiting Canada again soon. However it's anyone's guess what will happen at immigration. You might be allowed in. Or you could be turned away and sent home. Impossible to say.

Thanks for the replies, booking my flight home today. As for the $350, I had originally applied to extend my work permit but my employers lmo didn't arrive until a few days after it was denied and so I applied for a restoration of status (cost $350 total) which after months never arrived (I was advised not to go to the border with the lmo, I now know this is exactly what I should of done) While I waited I worked without a permit for cash up until the day before I was caught out at the border and this was discovered via messages on my phone, I wasn't aware they had to power to seize any items on or about your person to aid in their decision (I looked it up, they can pretty much do anything short of beating you) but then again I'm a f#*king idiot for keeping evidence of working illegally. I'm hoping to make enough money to come back as a visitor in July to see my girlfriend (Canadian, obviously won't mention this as the reason for my visit) and prove I can support myself until my departure and that I will depart. My employer has already told me that he will do everything possible to facilitate my return once I'm eligible to apply for a permit again, including providing legal aid if necessary (the benefit of being highly skilled in my trade)

Do you mean you were working before you became a permanent resident? Coz if you worked while being PR, it isn’t quite the same. What application was withdrawn? PRs do not need a work permit.

Hey man I am actually in the same boat as you. It’s quite a bit of time I was hoping if you could let me know what happened with your case. Did you find any luck at all? It would mean the world to me if you could clarify please.

Thank you
