Please Help: 9 months application still "In Process".

Hi all,

It's been 9 months since the sponsorship application for my wife (green card holder of US) has been forwarded to Buffalo, NY visa office. Last when I was asked to send them a "Record of good Conduct" from the country where my wife resided prior coming to US, which I sent them in Dec/2008. I tried emailing them and asking about the status of my wife's application, and the only answer I got back was this:
"We have requested background check from other government offices"
So, I don't know what to do now. Soon it will be 1 year since my wife passed her medical examination, and I believe the medical exam result will expire after 1 year, and I think she needs to pass the examination again.

I need some advise on what do I need to do now. Should I just wait it out? Should I ask them again? If I ask them again, is it a good idea? Please help...

Yes, unfortunately they'll ask you to do a new medical, and maybe police checks again (not sure about this one though).

We're in a similar situation, but London has been processing ours for 6 months, and responded to my query this week saying they were just waiting for the background check to complete. Another month or two of waiting, and my medical will be almost expired as well.

The background check is done independantly by Canadian Security Intelligence Service, and really seems to vary from person to person as to how long it takes. From what I understand once they finish the check, they just give CIC a positive or negative response. It's pretty much out of CIC's hands, so all you can do is wait and ask again later if it continues to drag on.

I'm just wondering what they look for with the background check if anyone knows... I know it's different for everyone but i've never lived anywhere but here or traveled out of the UK since i was a child so does this mean it could be quite straight forward or is it all unknown? Thanks in advance :)

just wonder whether it is normal for a family to be separated for such a long period of time just because they decide to take time with their checks?
if I resided just in one country & produced a police certificate of good conduct, will it still take such a long time for the application to be finalized?

I don't think it's a case of them "deciding" to take time. If it takes time, it takes time. Mine is obviously taking time, and I'm not really sure why. The same with Toledo. CIC aren't the ones doing it, so they have to wait for CSIS to complete the check.

It's all speculation really. The only people who would have a good idea, would be CSIS. But from the bits and pieces I've read from other people on this forum and elsewhere, things like living in more than one country for six months, any record of military service, things like that, may increase the time it takes. In my case I'm from Australia and have been living in London for 4 years. It may be something simple like Australia's intelligence organisation (ASIO) being slow in responding to CSIS. I'll never know. In your case, sure it sounds like it wouldn't take long at all. But who knows.

According to trackitt though, London has processed a few cases lately in very quick time (there's two there processed start to finish in 80 - 90 days...and that includes the sponsorship portion and time to get the passport stamped!). So either some background checks aren't taking very long, or as I read on another site, they decide who they'll do a CSIS background check for and it's not done for everyone.
