Hello, dear Fourm Members, please help me with some advices regarding my case. Today I recieved a email from my visa office to ask to take medical exams, pay RPRF fees for me and my wife in 45 days and to sumbit "the Original / Update Police Clearance Certificate (with fingerprints search/check necessary) from FBI". in 60 days.

However, in email it does not indicate which applicant (me or my wife) should send this FBI Clearance Certificate.

My questions is since my wife (spouse applicant) is the only person in my application who had spent more than 6 month time in United States in the past. This required FBI Clearance Certificate should be for her right??

Truly APPRECIATE if anyone body can give me some insights about this situation!

the requirement is clear....fsw applicants are required to submit police clearance certificates for any country which they have resided for more than 6 months since the age of 18 years old.

so since your wife has resided more than 6 months in the past - she should start on that requirement straight away

You can also send them an email if you wish to re-confirm - who has to provide the fbi clearance, it would probably take them at least a week to reply...so in all cases let your wife start with the requirement - as you have a time limit.

Thank you, emamabd. FBI website indicates it now takes about 5-6 weeks for Clearance check. I will send my wife's application right away today but I am not sure it will make the 60 days deadline or not. I think I can send my explanation letter to my VO if I can't make it on deadline of this FBI thing. What do you think?

Then it would be for your wife. If you feel the need to you can always email your VO and ask or visit if possible, but it would be for her. If they only gave you 60 days you had better rush!!!! Oh and Congrats!!!!! :D

sure, you can send them an explanation letter requesting them to allow more time for this requirement - an email would do the job



also Note:
* if your wife has submitted the fbi clearance before (at an earlier stage in the application) and never visited the US since obtaining the last certificate, you could also use that argument to request them to waive submitting a new certificate.

I've done that before, as i have resided in an EU country in the past, and have submitted police clearance during the application process...and when my medical arrived - they asked me to submit a new police certificate again from that country...and once i explained that i haven't been there since...they waived the requirement.

This could be the first time for my wife to submit her FBI clearance letter. (she did her college few years ago in US)

I am just curious to ask that is FBI able to get background report for anybody who ever been to US or just somebody who has to lived there for at least 6 month?

Do you know anything about this?

I have no specific information about FBI background check, but in general ..the police authorities in all countries usually issue certificates for current or past residents only
