Hello everyone,
I'm desperate for some answers as I need to make a decision in the coming couple of days about moving to Canada... If you have a sure answer to my questions I would greatly appreciate your feedback:

Facts: We are a family of 4 (my husband, me, daughter now 16, son now 14). We have landed in Canada and activated our permanent residency in April 2012. My husband has since then been to Canada several times looking for a job and accumulated a good number of days. Me and kids only have 26 days in canada. He just got a job and we want to join him.

Problems: very hard for many personal reasons to leave my country before June which is technically too late but I was told if the reasons are valid we might get in but not out anymore until renewal. My dad is sick I can't not visit him for over 2 years!

Questions:
1. Can I get in based on the valid reasons and then renounce my PR status (I can stay for 6 months afterwards right?) then my husband sponsors me since he's a resident? If yes how long does this process take?
2. If that is not an option, can I get in then get a housing mortgage and buy a small apartment and then renounce my PR since I heard if you have property in canada you can always obtain visit visas? if this is true how long can I stay with a visit visa then (in total and per stretch)?
3. My son will be less than 18 when we renew so not accountable for his missing days, but my daughter would be 18 by that time. Will she be in trouble? will she need to renounce like me and reapply?
4. Is renouncing PR a black item in my file? does it make it harder to be accepted as a resident later on?

Sooooooo sorry for the long message but I'm really in a state of panic! I need your help...

I would ask a lawyer but the CIC would probably be wary of issuing a new PR for your family later on giving you didn't have one long and then left. But I'd ask a lawyer to be certain.

If your daughter renounces her PR, she will not be able to be sponsored again by you or your spouse - she'll be too old.
You can renounce your PR, then get re-sponsored later by your husband. Depending on your country of residency, you may have no trouble visiting Canada. If you need a TRV, it might be hard to get.

Life give all of us difficult choices,
Immigration Canada considers that fact that many people face similar situations as yours,
but they chose to stay in Canada, and not to renounce because they value Canada over
many everything else. You need to consider the way that your situation will be evaluated,
In the case of your daughter she wont be able to be sponsor as family class ever again.
If you ever go back, she will need to stay, she wont be able to join since the age for dependants
has changed now to 18 years.

You do not need to renounce your PR status. You can travel to and from Canada whenever you like as long as you have a PR Status. If you renounce your PR status and your husband sponsors you again it will raise questions which can delay the processing of your application at that time and could also result in refusal. It can take upto a year for a final decision on spousal sponsorships.

I am not sure about how long you can stay if you renounce your PR status. But it seems a bad option to me.

2. If that is not an option, can I get in then get a housing mortgage and buy a small apartment and then renounce my PR since I heard if you have property in canada you can always obtain visit visas? if this is true how long can I stay with a visit visa then (in total and per stretch)?
It is not guaranted that you will get a Visitor Visa if you own Property in Canada.

3. My son will be less than 18 when we renew so not accountable for his missing days, but my daughter would be 18 by that time. Will she be in trouble? will she need to renounce like me and reapply?

Under new rules, a dependent must be under the age of 18 at the time of sponsorship application is filed and received by CIC. So your husband or you will not be able to sponsor her as a dependent.

4. Is renouncing PR a black item in my file? does it make it harder to be accepted as a resident later on?
It will surely be looked upon by IO and will be questionable.

I will recommend that you keep your PR status. Move to Canada with your Daughter and Son.

Stay in Canada as long as you can.

Since you are thinking of staying for 6 months at a stretch on a visitor visa after renouncing your PR status, it will be better that you do it as a PR.

If you need to travel back to your home country, no one can stop you. Keep your visits out of Canada Short. Accumulate as many days as you can towards maintaining your PR status in Canada.

While you Visit your father, your daughter and son can continue to stay with your husband and accumulate days of stay in Canada to fulfill the requirements to maintain PR status.

This way your daughter and Son will have no problems at the time of renewal.

If at the time of renewal, you fall short of days you must have stayed in Canada to maintain PR status and CIC asks then you can explain to CIC/PR Renewal Office the reasons for your absence. CIC will consider it favorably since your husband, daughter, and son will be in Canada (provided they maintain their PR status). You will have strong family ties in Canada.

Hope it answers your questions/concerns.
