First of all, hello people of this forum, my name is Daniel and I have come here to seek some advice.

My situation is this...

I immigrated to the United States illegally with my parents back in 2001 when i was just 6 years old, but I didn't know I was illegal until about 5th or 6th grade. I have lived here for the past 10 years and have been going to school and I am going to be a Senior at an Early College High School in the 2012-2013 school year (My 18th birthday is in Sep. 2012 and I will have acquired 8 months of illegal presence by the time I graduate in May, since they don't count illegal presence as a minor). I'm planning on applying to the University of Ottawa and other universities in Ontario so I can go to Canada and study. However, I have to leave the U.S. and go back to my home country (Mexico) to apply for a Canadian visa first, since I can't do it in the U.S. because I was not legally admitted. I don't have any kind of criminal record at all because I've never been arrested at all.

My questions are:

As far as leaving the United States...
  • Can I just order a plane ticket and fly back home without being deported or being granted voluntary departure?

  • Can I apply for voluntary departure in the U.S. without going through removal proceedings or alerting the ICE or Homeland Security?

As far as applying for a Study Permit and Temporary Resident Visa in my home country...
  • Am I criminally inadmissible to Canada if I leave the U.S. on Voluntary Departure?
  • Can I apply for a Temporary Resident Visa at the same time that I'm applying for a Study Permit?

If I could get a quick response as soon as possible, I would really appreciate it.

Will I have to apply for a TRV after I get the study permit letter of introduction or does it come the Study Permit Introduction Letter?
I plan on applying at the Canadian Embassy in Mexico City.

no my dear friend ,
Student permit is enough to stay there in canada as long as duration you got .
and TRV you can apply after the studies to stay there on temporary basis.

I have decided to apply for Deferred Action for Childhood Arrivals, which protects me from deportation for 2 years and I get a work permit for 2 years. After I get the work permit, I am going to be working part-time until I graduate in May 2013, and then full-time afterwards. Since I will have the work permit, I will apply for an I-131 Advance Parole, so I can leave the country legally and be able to return legally, so I am able to apply for a Canadian Visa from the U.S, instead of having to go back to Mexico to get a visa. I'm not going to uOttawa until 2015 now, since I have to save up for at least my first year expenses in Canada. Sorry I couldn't get back to you earlier Dav1d0, but I am not allowed to send personal messages just yet.
