Hello everyone,

My case is quite complicated. I read 20 pages in this room but nothing similar.

I became PR of Canada in Apr2015 but left in May2015 to come back to my country of citizenship Vietnam due to my job and my mom's health. I plan to go back to Vancouver in May 2017 and live permanently there. I think there would be no problem with residency obligation as I won't be out of Canada for >3 years.

I'm planning to adopt 2 orphans (a 10 years-old boy and a 6 years-old girl, non-siblings) from an orphanage in Vietnam where I've been in contact and supporting the kids in the last 8 years.

The adoption process in Vietnam is quite simple for a Vietnamese citizen. No need of adoption agency. It would only take 2 months, after that I would have the adoption certificate certified by Vietnam government and can also change their birth certificates to my name as the single mother. I want to bring them to Vancouver with me next year.

My understanding from CIC (http://www.cic.gc.ca/english/information/applications/famcls.asp and http://www.canadainternational.gc.ca/uae-eau/consular_services_consulaires/adoption.aspx?lang=eng ) is that I can apply for their PR visa under Sponsorship of Adopted Children using letter of no involvement (instead of Letter of no objection) issued by BC authority.

I greatly appreciate your advice on any concern/challenge/legal issue with my plan, and if you’ve ever known a similar case.

I really really want to give these unfortunate kids a chance of a new life.

FYI - as a PR, you must be living in Canada in order to sponsor the children for PR. You cannot sponsor them while outside of Canada. If you want to bring them with you when you come to Canada, then you'll need to apply for a TRV. If that's refused, you'll need to try for a TRP. If that is also refused, then you will need to travel to Canada ahead of the children to submit the sponsorship application and then wait out the processing of the application in Canada. So there's a possibility you may have to be separated from them for several months while the sponsorship process is completed.

Unfortunately I can't answer the rest of your questions - hopefully someone else will.

Thank you so much @Scylla for your kind response. May I ask some more questions for clarification ?

1) By "you must be living in Canada", you mean the condition in this guide http://www.cic.gc.ca/english/information/applications/guides/5196ETOC.asp ? That also means there is only 1 option of inland application as I have to go back to Canada and submit the application in Canada ?

2) The processing time is determined by sponsor's or sponsored children's location ? In this case should I check Vietnam or Canada ?

3) The official processing time for application in Canada is 22 months, but I read in the forum that for minor dependent children, there are cases < 6 months ?

4) Do I need to meet Low Income Cut Off ? I'm single and my income is for sure >25k CAD/year but it comes from my salary and rental apartments in Vietnam. I don't have income or tax files in Canada.
The guide says "Note: The minimum necessary income requirement does not apply if the person you are sponsoring is a child you adopted or intend to adopt in Canada and that child has no children of his or her own."

1. There is no inland option to sponsor dependent children. You must be residing in Canada while the outland app processes.

2. You need to look at the Vietnam processing time.

3. The in Canada processing time will not apply.
