Hi - Hoping to hear from someone with specific experience in navigating channels of child custody in the Philippines. I have previously posted about this and had good feedback/suggestions from some forum members, but none with actual experience in the Philippines.

The scenario: We have applied (JAN 2014) for spousal PRV for my Filipina wife & her 6-year-old son. I have been approved as sponsor. When we submitted the application we did not include the form IMM5604 (a release from the non-accompanying parent) because we were told by the Philippines social services (DSWD) and a lawyer that my wife has de facto sole custody of the child because the biological father is not named on the birth certificate (hate the label but for all intents & purposes the boy is "illegitimate" in the law's eyes).

We made a note in the "child custody" section of the application to this effect and included a sworn affidavit from my wife as to everything she has done as sole provider for the boy. I'm a bit concerned now that this may not be sufficient, that CIC may require a court issued judgement of custody in lieu of form IMM5604. (The easy thing would surely be to have the bio-dad complete the 5604 form and return it to us to send to the Manila VO. But my wife isn't sure she can find the guy, doesn't really want to speak to him, and isn't sure he would cooperate. She put this clown behind her 5 years ago & has done an amazing job raising "our son" that for me the psycho-emotional fallout of trying to find the guy is a course of action that is just not worth it.) Such a judgement could also take quite a while -- or this is where I'm hoping someone may have real Philippines experience??!!

Regarding France, I have been in contact with their embassy in Manila (yes, they actually respond directly to your emails!) because I have the possibility of working over there again (I also have a UK passport & can therefore work/reside in France as easily as I can move from Ontario to BC). The French confirmed that the boy's birth certificate as it is is sufficient proof in their eyes that his mother has sole custody and he can leave the Phils permanently accompanied by her. Even better, the whole process of me bringing them to Europe would take a couple of months tops!

I am actually working on a project in Europe right now, so I can't reach the call centre from here, but this forum is often a better knowledge source anyway imo :) We put a lot of work into preparing our application for Canada and I don't want to "bale" on it just yet, but I also don't want to wait to get a letter much later this year from the VO saying that they require IMM5604 or a judgement of custody for the application to proceed....and then it taking who knows how many more months for a solution to that! Sooooo, anyone with any real experience in this out there who can weigh in? Know it's a bit of a long shot but figured I'd try. Thanks!

Post it in Tagalog too, written by your wife (if possible). It will increase your chances of getting a hit with someone who can speak from experience.

That's a great point truesmile, I didn't think of that. That one Manila thread is practically nothing but Tagalog. Seems hard to 'interject' in that thread too, so many 'inside' conversations happening. Oh well, worth a try.

Hi try reading that note..under the Philippine law, as long as a child is illegitimate and in our wife's case, there's no acknowledgement of paternity..she's got the sole parental authority..it doesn't matter if the child is over 7..in my case, i was once married, my eldest son was alienated fr me, that's why i had to go back home in 2012 to file for a petition for custody..went back home again in 2013 to attend the final hearing, during that time, my son was over 7, he was asked to choose between me and my ex..its traumatic on their part but thank God he chose me..i just got the court order, and the Philippine court was in favor of me..i have now the sole parental and legal custody of my 2 sons..dont worry everything will go smoothly on your part! All the best!

Oh no problem..ur very welcome..i also try to do some readings about The Philippines' Family code coz i am as well preparing and gathering all documents and requirements for my husband's sponsorship..Also check DSWD website abt travel clearance for minors out of wedlock, and ive read once in this forum same situation as yours that she had her lawyer draft an affidavit of abandonment explaining that the father wasnt in the child's life fr the very beginning and also citing the Family code's rule on illegitimate children..U guys will be fine..Cheers!

The only info I could get from the DSWD web site about travel clearance for minors had to do with the child travelling with someone other than a parent, haven't been able to find anything re: travel for "minors out of wedlock", so if you have any links to that situation I will once again appreciate your "angelness" :) Yes, at first I didn't think much about that affidavit (as it referenced a brief relationship that existed with bio-dad) but now I know it was money well spent as he covered off all the points....except a reference to the article of law (that you provided in that previous link) would have been nice. Though CIC should be aware of this as well you would think....just gotta hope the right officer treats the file maybe?

Oops, didn't scroll down far enough on the DSWD page covering this (http://www.dswd.gov.ph/faqs/travel-clearance-for-minors/): "Illegitimate children are under the custody of the mother. If they will be traveling with the mother, they are not required to secure a travel clearance from the DSWD. If they are traveling with person other than the mother, they must secure a travel clearance." So that pretty much covers it I would say! Hi guys! I'm so sorry to butt in here but I have a similar case. I was just hoping someone could help me with my questions regarding the process of child custody case in the Philippines based on their own experience. I am currently filing a child custody for my 9-year old illegitimate child who is bearing his dad's last name and will be applying for my permanent residency. I'm raising my child on my own and he has been with me since birth. Here are my questions:

1. How long will the court decide on this case in the Philippines and how many hearing would take place?

2. My lawyer will provide me a petition letter which I think will state that the case is still ongoing, will the CIC still process my application if I will only provide this for now since they are asking for the court order (the 1st hearing will still start this month)?

I would really appreciate it a lot if someone can tell me an actual experience in our country. Thank you!
