PGWP with a DUI charge - Flagpoling or online application

Hi,

I'm an international student who completed studies with GPA 4, have received letter of completion and official transcripts. Under the unfortunate circumstances, I was charged with DUI in Feb 2023 and my hearing date is on 31st Oct 2024, while my current study permit is expiring on 30th Sept 2024. My family's status is dependent on me. I'm in the need of getting a PGWP to apply for work. I'm contemplating between if I should attempt for Flagpoling along with my family or go for online PGWP application or both. My case may take longer to get a verdict and without PGWP in hand, many companies do not offer you until you have a valid PGWP in hand. I'm consulting with immigration and litigation lawyer as well. Any inputs and guidance from anyone's experience on what are my chances to receive a PGWP via Flagpoling / Online application, will be much appreciated.

Flagpoling will very likely not solve your issue. What you really need is a very good criminal defense attorney and also an immigration attorney.

Should have thought about your family's dependence on you before (allegedly) drinking and driving.

The law is the law. Get a lawyer, hope for the best, and be prepared to have to leave if things don't go the way you want them to.
