PGWP Refusal

Hello all there,

I have completed by graduation during current year and received my graduation letter along with official transcript. I had enrolled in 2 year full-time program at authorized college. I failed in one of the course in 3rd semester and reappeared for its exam during my college scheduled break. However, I have been recently notified for PGWP rejection stating a reason that I have not complied with eligibility requirements of full-time enrollment in the study program.

Appreciate, if anyone could advice with necessary actions / procedure to be followed for reconsideration / reapplication of PGWP.

Thanks in advance.

Hi,

There was an official scheduled break in winter session as per college policy. I have gone through few guidelines wherein official scheduled breaks as per college policies are considered as "gaps considered as actively pursuing studies: i.e. students are considered to be enrolled full-time for the program.

Also, my college has issued me a course outline letter stating that it was officially scheduled break and that students are validly enrolled as full-time during tenure of program.

Did you explain this in your initial application? The officer probably saw a semester with part time studies and decided to reject , that's why its important to explain unusual situations.

You should call them and send a web form requesting a reconsideration.

You need to explain it in the reconsideration then.

Hi,

Thanks for your responses.

Could you please guide if college issued course outline letter is sufficient as supporting document?
Any regulations link that I can submit as part of explanations for scheduled break which would suffice my reconsideration application?
Any contact / know person who has faced similar issue?

Hi,

Thanks for prompt response.

The reason was not explained in initial application. That's the reason this issue has emerged.

Could you please guide on draft explanation or documentation requirements etc.

Get a letter stating from your college you were a FT student.
As long as you maintain a certain threshold colleges consider you FT.

Now, you retook a course in scheduled break which is fine, maybe the officer though you were PT.
So get that letter from your school, talk with your schools immigration advisor, am sure they will assist you.

A draft doc may look like

"Been a full time student, maintained FT status as per college, took course again in "scheduled break" and so on....!
