PGWP Refusal

Hi
I graduated in January 2020. I was working part-time during my school and continued working after I graduated assuming I was allowed to work on a study permit for upto 20 hours. I went to POE to get my PGWP, they refused to make an application because I worked after my graduation date without applying for a work permit and advised I should apply again online. They issued a 6 months visitor status. I hired a lawyer and started working on re-applying my work permit. He re-applied for the work permit but did not apply for restoration for student status. I applied for it on 10 March, 2020. After 9 months, on 7th November 2020 I got refusal letter from IRCC stating :
I am refusing your application on the following grounds:
• Pursuant to subsection 11(2) of the IRPR, an application for this type of document cannot
be submitted within Canada. An application of this type must be made at a Canadian visa office in
another country.
• You do not hold a valid study permit or visitor status or you do not hold implied status as
a student or visitor
You are welcome to reapply if you feel that you can respond to these concerns and can
demonstrate that your situation meets the requirements. All new applications must be
accompanied by a new processing fee.

I don’t know why they refused it? Is it because I did not restore my status as a student? What should I do next?

When did you receive confirmation that you graduated? Was it January 2020? Once you got confirmation, you needed to stop work immediately. Once you applied for a PGWP, you could start working. So is seems you worked illegally & were rightfully refused.

I didn’t know that rule. I stopped working the day I got to know about it. I know it was a mistake. What should be done next?

You can get accepted to another program & apply for a study permit. When completed, follow the guidelines for a PGWP. Or if you have enough points (470) for Express Entry-FSW, apply & wait for an invitation. Or Learn French & become fluent. If you want to stay in Canada as a visitor make sure you extend, if required.

If you want to stay in Canada as a visitor make sure you extend, if required.
Yes, I’m planning to get LOA from a school and then apply for study permit. Can I stay as a visitor in Canada and apply for study permit? The visa application centres in my country are closed! Please let me know if you’ve any information about it. Thanks

Yes, I’m planning to get LOA from a school and then apply for study permit. Can I stay as a visitor in Canada and apply for study permit? The visa application centres in my country are closed! Please let me know if you’ve any information about it. Thanks
You can stay if you have a valid visitor visa. Your processing will be done from your home country even if you apply from within Canada as you have waited too long between programs (more than 150 days). Be prepared that it may be refused because you worked illegally in Canada. You will need to show benefits for the program, proof of funds etc.

You shouldnt have mentioned the work, but it seems they didn't actualy give you a refusal at border only told you to go online? How did you not have a study permit when you applied online? You need some sort of status to remain in Canada you should probably get visitor record but not sure how that works.

They did say they cancelled my student status and now I’m on visitor status

HI guys I have a question I been hella stressing out!!!
I studied at Langara college for 1.5 years and got 36 credits which I then transferred to UBC. I have been at UBC for 3 years and will be graduating with a degree from UBC at the end of this year. However, while I was at Langara College I studied one semester part-time where I only took 2 courses. But at UBC I maintained full-time studies for 3 years. I was wondering if me doing one semester part-time at Langara College will affect my chances at getting a Post Grad Work Permit?

They cancelled it at the border? Or now after refusal of application? I dont understand why you were denied the online application, you can apply for PGWP without study permit as long as you have status.

If I get failed I have to wait for 8 months to start next semester. So unfortunately I got failed in my last semester and I have to wait for 8 months to start my 4th semester. And I didn’t take any course in between that time. I didn’t explain anything in my first pgwp application. And I got refusal, but now I applied again with supporting letter and applied my restoration status as a student. I just want to know about the success rate of this situation.

So you were rightly refused. If your supporting letter is successful, let us know. What did you do for 8 months as it wasn’t a schedule break?
