PGWP - FSW ITA recipients - Next steps?

I am a PGWP holder working in Canada since 2013 after my Masters here. I was eligible for both CEC and FSW (My answers were Job offer: Yes, LMIA: No). I received ITA for FSW in 5th draw. Given the confusion around valid job offer definition and why international students who are working here were being invited under FSW - I wanted to know from folks in similar situation about next steps.

I have reached out to CIC for case specific query on whether I should decline my ITA and update my profile to Job Offer: No, LMIA: No, decrease funds and wait for CEC ITA. I have done this to avoid future complications in my application evaluation.

Has any one received any 'official' feedback from CIC ? If so, please share.

Hey, I am in a similar situation too. I am on PGWP with a year and 3 months experience. I got invited under FSW although I was eligible under CEC too. I answered Yes for the job offer and No for LMIA. I declared 20k which should support my single application under FSW.

In the list of documents, it asks for two documents regarding employment.

1. Offer of Employment: I guess this should be offer letter of my current job issued to me when I started (without LMIA)

2. Employment Record: This is again the experience letter for my current job confirming that I worked for more than a year and my current status of the job.

Correct me If I am wrong. Also, people who got invitation under CEC please reply the documents you are asked.

I am in similar situation as well, same dilemma whether to decline ITA cause of such minor errors on my profile or just go ahead and explain the same in explanation letter. BTW, I was invited on March 27 under FSW CRS score 464. ???

Hi,

I had the same situation, i got ITA 5th round. But after seeing the document check list and knowing of the small errors i made, i declined my ITA and updated my file. I said NO to job offer but my POF is 12k that's why i am still eligible for CEC and FSW. But this time I am sure I have the correct information. I also said NO to certificate of qualification even though i thought i have a qualification since i work for bank and i can not work without my current licenses.

I think it is better to be safe and make sure there are no errors, if we apply and we get rejected after few months it may be to late to fix the profile and re-apply since this year cap may be reached by then. If we decline now the chances of getting ITA next week again is almost 99% I guess.

I think what all of us need to know is whether our current salaries in ongoing, non-LMIA jobs count toward showing proof of funds. I asked CIC this over the phone and was told yes, it did, and so I am uploading my T4 and NoA as well as my bank statements. However, I don't have this answer in writing, and my document checklist does not ask for the T4 or NoA, so....

There was no way, though, that I was going to turn down the ITA, as I thought that was foolish. I answered the same as you, Yes to job offer, and no to LMIA, and that is the truth and not a misrepresentation. I see now in CiC's instruction page that we were meant to say no to job offer, but I filled out my EE profile and got the ITA too early to know that. I also had to downsize my 'available funds' on the EE, as I originally included lines of credit and later saw that I shouldn't. I changed it before getting the ITA, but the ITA still has the original number.

None of this makes me want to turn down the FSW ITA, as I still meet the requirements. Yes, CEC is unfairly easier, but no one knows how many more invitations will go out through Express Entry, and I don't take the fact that I have one lightly!

If someone knows how to email CIC to get a response in writing, I hope you ask whether the salary of a current, permanent, non-seasonal job without LMIA support will count as proof of funds. I'd love to know the answer.

Do you mean to say you don't have the necessary amounts to show as an ITA under FSW and if CIC will consider being salaried in Canada as a sort of a waiver for this requirement?

I am waiting for my ITA in the next draw (hopefully in a couple of weeks), I just got my score bumped to 467 as a result of my new IELTS score. I am eligible under CEC only, I have filled in Yes for Job offer and No for LMIA. Do I need to change it? If I do change it, do I lose points for that?

I am lost about this, please advice me accordingly. Thanks in advance.

I should think your points will not reduce as job with LMIA is an additonal 600 points and since you didn't have lmia (since your answer is 'No' to that question) you never had any points for that. But it is confirmed that if your job is one without LMIA you should provide the answer as 'No' to the Job Offer question.

Thanks for your quick response @ SnakePlissken. I am confused from reading so many threads can you please summarize why we have to say no to the job offer? My understanding is that because we don't have an LMIA so we have to show POF? Please correct me if I am wrong. Does it make any difference if you get an invite through CEC?

The whole issue is based on CIC's definition of what constitutes a valid job offer. That and the Answer to your first qn is contained in these 2 links:

Your second qn: For PoF: If you are invited as an FSW you should have the mentioned funds as per reply #5 on this thread by ITA469. If you are invited under CEC, it doesn't matter if you don't have funds as it is not part of the requirements for CEC as per my understanding.

I used NO in the intended job in Canada during filling up EE profile. I got ITA in 7th draw in FSW category?? Cmon, I was thinking to get CEC as I also qualified for that and I did my masters here.

Now, I was going through the document checklist of FSW. I am doing a job which is full time and permanent. I don't get what the arranged employment means? It says, the employer need to mention upon getting PR I will be offered permanent fulltime job. Its surely confusing, because I am already doing that kind of job.

Another confusion is, in another form, it asks do you have a job offer? In online form I said NO, so should I say NO there as well?? ??? ???
