pgwp complex case

so i have two continous semester gaps between my studies

may to september (which was a scheduled break from college and mandatory to take)

september to january (authorized leave due to medical reason ) - In this peroid i left canada and right now i am in my home country and will be returning next semester to resume my programme.

my main concern is that me taking my scheduled break (4 months- may to september) + authorized leave (4 months-september to january) = 8months in total create any trouble for pgwp?

On the IRCC website it says :
A student on leave who begins or resumes their studies within 150 days from the date the leave commenced (that is, the date the leave was granted by the institution) is considered to be actively pursuing studies during their leave.

But it does not says anywhere that you cannot take a leave of abscence right after scheduled break.

So there is nothing mentioned about my summer break on my transcripts and my leave started in fall term. There is an official withdrawal date mentioned on my transcript for the fall term. And also I have the email communication with my department as well which shows the date in the fall term when I asked for leave.
The thing is I was enrolled in my fall term after I came back from my summer break. I attended one weeks class and then I took a leave.

Thanks for the additional info. With that, and I will say again, that this is my opinion, since you were enrolled and attended for a week before withdrawing, then your day to start counting the days on leave starts when your leave was approved.

oh okay...thanks so much for your input. just one thing more.. do you think that when applying for pgwp in explanation letter i should mention about my summer break peroid or just explain my fall term leave peroid with supporting documents.

here is my timeline

sept 2022 - 1st sem full time
winter 2023 - 2nd sem full time
may 2023 - summer break or scheduled break
sept 2023 - authorized leave for a term ( leave authorized on 14th sept)

winter 2024 - 3rd sem full time
summer 2024 - 4th sem full time

I don't think it's required because it doesn't count, your leave started Sept 14. But you should include the docs of why you requested the leave, copy of the leave granted by the school and the supporting docs from your health care providers.

This is just my opinion also. Since the break and leave happened in the past, regardless of what the rules says, nothing can be done to correct it at this point. Only way to find out if you will get PGWP is apply. The final verdict would still fall under IRCC alone. I would suggest, though, to include a letter of explanation together with your authorized leave letter from your DLI.

I think, and again just my opinion, you have a fair chance to get PGWP. You are not the first international student to take authorized leave.

Just want to add, same scenario would apply to students applying for authorized leave on January intake. After the winter semester comes the Spring/Summer semester which is usually a break in almost all DLIs.

yeah but in this case don’t their leave exceeds 150 days.
Because on the IRCC website it’s mention that a student should resume studies within 150 days from the leave started ?
I don’t know. I think IRCC should update and be more specific about breaks and leaves on their website. I think it’s kind of a ill defined area on there part

Well, think about it this way, a student applying for authorized leave in winter semester would not resume their studies within 150days since the student would be on summer break after that. So, students applying for authorized leave would either have them in September or January. Either way, the length of leave would be the same.
