Please what do you mean? I do not understand?

I'm in Canada and I'm out of status already. My status ended the day my PGWP application was refused and I was given 3 months to restore status and reapply.

So I have re-applied for PGWP and also waiting for the reconsideration.

What do you suggest I should do?
So you have status if you were given the option to restore status and reapply. So you did that but also asked for reconsideration. Why were your refused - being part-time?

Yes, that's right.

I was refused for being part time during one of the semesters, and that's incorrect. I was full time throughout program.

What can you advise my spouse to do?

My spouse is also in Canada on SOWP. We applied both PGWP and SOWP extension together and we were both refused. My spouse was also given option to restore status and reapply again. But my spouse hasn't re-applied yet because we are scared it will be refused again since I'm no longer working.

Well spouse is not eligible because you don’t have a job. It would be refused again.

So he has to wait until my PGWP is approved and start working again before he can apply again.

However, he has 21 days left out of the 90 days to restore his status?
What can he do to remain in Canada if the reconsideration or my new PGWP is not approved in the next 21 days?

He can change status to visitor. If you don’t have a job and paystubs on your PGWP, he is not eligible to apply. So you need PGWP approved, get a job and paystubs and then apply for SOWP.

So why do they think you were part-time for one semester?
I didn't know either, I think it was the Officer's mistake.
When we called IRCC, we were told the officer noted that I did part time during fall 2022. However, I did 4 courses (12 credits) that particular semester, and was clearly shown in my Transcript.

Is spouse in Canada? If so why is spouse applying for visitor visa unless leaving Canada and then wanting to return? Apply for visitor record (Change status).

Yes, spouse is in canada. He has 90 days to restore his status.

And yes, he's applying for Visitor Record.

But while filling the questionnaire on GCKey account, there is a question

"Are you accompanying a family member who has status in Canada?"

Do you think the answer to this should be "Yes" since we are both in Canada

Someone should please help respond ...

Also, in the explanation letter, does my spouse have to explain the reason for the visitor record application is that he wants to remain in Canada until I get my PGWP, so he can apply for his SOWP, right?
Does he also need to provide documents for home ties like Property documents ?

Good Afternoon Everyone

Please, my refused PGWP and my spouse Open Work Permit applications were finally re-opened yesterday after exactly 3 month I sent the reconsideration request.

They uploaded the BVL on our applications and the status changed to submitted. However, there's no email/message requesting for the refunded cad$ 100 Work Permit Holder Fee.

Please, what does this mean? And what do you suggest we can do?

Hi Naturgrl and everyone,

Please, kindly assist with your opinion on this?

When my PGWP and my spouse SOWP extension were efused, my spouse applied for Visitor Record as you advised above, and we also applied for reconsideration on the refused work permits.

Now, our reconsiderations were approved last week (my PGWP and my Spouse SOWP are approved) and also today my spouse Visitor Record is also approved.

Does the new Visitor Record not invalidate the Open Work Permit?

Please advise, thank you.
