Mu Post Graduate Work Permit expires soon and I have to apply for an open work permit. My employer has applied for a LMO. I have two questions:

1. How many days before the Post Gradutae permit expiry am I required to apply for a work permit extension.

2. If I inform them in my application that LMO is applied for but not yet received what do I have to subit as documentation for proof that my employer has applied for LMO which is not yet received.

I think you are confusing 2 things here.

PGWP is only one time deal. You can't apply for OWP or extension of PGWP once the original PGWP is expired.

In order to get a WP, you need a valid LMO. Employer applied for LMO in your documentation does not count.

I am aware of the PGWP being a one time deal. I am referring to a regular work permit application to replace PGWP when it expires while I wait for a decision on my PR application under CEC.

I was under the impression that regular work permit could be applied under "implied status" if the LMO had been applied by the employer but not yet received. This option is even available as a response on the online application form.


I just wanted to know the deadline of when to apply for aregular WP before my PGWP expiry. Is it one month or can it be closer to PGWP expiry?

Also what proof has to be attached with the application to confirm that employer has applied for LMO?

At least 30 days is recommended.

2. If I inform them in my application that LMO is applied for but not yet received what do I have to subit as documentation for proof that my employer has applied for LMO which is not yet received.
If you don't have a fax confirmation or acknowledgement from Service Canada, mention the date of the LMO application. If you apply for an extension before the pgwp expires, you will be in "implied status" as long as you continue to work for the same employer.

Your employer should apply for the LMO about 12 weeks before your permit expires.
I would apply for the work permit about 1 month before your current permit expires. If you've not yet received your LMO by that time, simply provide them with a copy of the submitted LMO request and with any documentation that says it's been sent off at an earlier date (say a fax confirmation, etc.).

The online application, as far as I can tell, does not provide an option for me to attch any proof that the LMO has been applied. Does that mean that I should make a normal paper application as I can then attch the proof of LMO application> Any guidance will be appreciated as I want to get my application right the first time I complete it.

For an online application, you need to have some documents in electronic format like the pages of your passport, etc. How about scanning the passport pages and any proof of the LMO application as one attachment? Be sure to label the LMO proof as such so that a visa officer knows what he/she is looking at.
Currently processing times for paper applications is 23 days, so you can do that instead. Here are processing times: http://www.cic.gc.ca/english/information/times/temp.asp

When I spoke with a CIC rep, he mentioned something about calling in after the WP application has been sent in to let them know you've already applied for LMO and are still waiting. However, they also say that if you've not yet received your LMO, you should wait til the last two weeks before your current WP expires to apply for the new WP.

If you have any doubts, just call CIC.. The rep I talked to was really helpful and even sent me an email with all the details.

Exactly right. You can only apply for a work permit without the LMO if you (a) have already applied for the LMO, and (b) your current work permit will expire within the next 2 weeks...

You should explain that they won't be sponsoring you per se but simply providing an employment letter to confirm your job. You still have time on your pgwp, so you shouldn't worry about LMO at this point.
