PGWP Amendment Rejected - What is my next move?

Hello forum members!

Long story short: I applied for the amendment of my PGWP because of an error regarding the expiry date. I sent all the evidence to Ottawa for this error along with a letter explaining my case. I talked to CIC Call Center before and they recommended I should send this application since there obviously was an error. Yesterday I received my PGWP along with a rejection letter stating "We are not satisfied that an error has been made. You can apply for extension with applicable fees". I called CIC Call Center again, explained my situation and they told me "A decision has been made. There is nothing you can do".

It is quite shocking that they would ignore the obvious error they made in the first place! My case was obvious and strong with all the evidence. Does anyone have a suggestion about what my next move should be? Paying again for a work permit because a CIC officer working on my case made an error is not an option...

I'd appreciate some input. Maybe some of you has been in a similar situation before... How to deal with this?

What was the error? I doubt you have any other options since they've already refused to change your PGWP.

The issue is that the expiry date is way shorter than the length of my program of study. At first, they said "Oh, it might be because of your passport expiry date" but nope, there's no problem with that. They have made an error and they are not fixing it I sent official letters from the University twice now... I did everything right. I even referenced to their policy, explained my case extremely clearly.

It's true that work permits (and visas) are strictly not issued beyond passport expiry in Canada one way or the other. For a similar perspective, my LMO stated work permit for 3 years, which was shortened to 2 years 1 month to match passport expiry and exactly the same comment was put in remarks.

Moral of the story, you have to apply for extension, citing the reasons.

Yes but in my case, my passport expires in 2020 and the work permit was given till 2015. So, there is a clear error. It is so clear I cannot believe CIC does not admit it. My program of study was 2 full years and they issued my permit for way less than that when their policy clearly states:

"If you studied less than two years but more than eight months you may get a work permit for a period no longer than the length of time you studied (for example, if you studied for nine months, a work permit may be issued for a period of nine months).
If you studied for two years or more a work permit may be issued for three years."

Its given based on total credits you complete, not just duration.

My question would be, why would the OP send it to Ottawa, since they don't process work permits, Vegreville processes them.

It appears that the office in Alberta takes care of extensions and such. I still haven't found an answer as to what to do other than request to amend again and again... CIC doesn't seem to have a process for appeal with regards to the temporary resident documents, such as a work permit.

You shouldn't have sent this as an amendment. That's why it was refused. If you had bothered to read the amendment guide, you would have seen that only the following information can be amended:

•Family name
•Given name(s)
•Date of birth
•Place of birth
•Country of birth
•Citizenship
•Sex
•Marital status
•Date or original entry
•Date of landing

That is the Query Response Centre/Operations Support Centre, Ottawa , where they will only amend personal information where an error was made, not duration of documents.

Okay, CIC officers told me this was the way to go, but I see your point.

Though does that mean the duration requires application for extension then, which is not free? Why would I pay again for an error they made? Even if I accepted this and paid and apply for extension, post graduate work permits are issued only once and not extended. What am I supposed to do? ???

Update on my side: I did nothing and explored my immigration options instead. I hope to be under an implied status at least by the time the work permit expires.

It sucks because an error was made by CIC and I suffer as a result, but I didn't want to pay again. It is an option though, if you would like to do that. You can apply again explaining the current situation.
