we applied for our parents in 2021 in the pgp program, recently we got email from CIC to provide them with option C for year 2018. On researching we found out that EI income doe snot count towards the minimum income threshold. our income for year 2018 after deducting the EI is falling short by just a few hundred dollars. Does anyone know what should be done in this scenario?

Do you have any income you failed to decare to make up the gap? Unfortunately there's no flexibility on LICO. If you're below the minimum then you don't qualify. How long have they given you to respond?

we tried refiling the 2018 return with CRA, today they sent us a generic reply, that since u will owe us the money we will not re-assess your return.
we have deadline til Dec 10.
we went to accountant, he advised to fill a waiver form t2029 which is approved by ministry to reassess the return but it may take upto 1 year for the process.

looking for all the possible scenario's and experiences from people if anyone has any... please help

Definitely wait for others to respond.

I think you need to somehow convince IRCC to keep your file open until the T2029 is approved and your return is reassessed. I don't think IRCC will proceed with your application without a reassessed return that meets LICO. They will either agree to keep the application open or make a decision based on the information they have now. I would provide evidence th T2029 has been submitted along with evidence of the income that wasn't declared.

Did you manage to refile your 2018 return?

In that case you should be expecting the application to be ultimately refused for failing to meet income requirements. Once the application is refused, I guess you can try appealing with the help of a lawyer. Note sure what the chances of success will be.

It depends on if you check continue to process, if so, then as scylla mentioned, you can try appealing with the help of a lawyer.

If we refuse you as a sponsor
If we refuse you as a sponsor, you can choose to have us keep processing the application for permanent residence for your family members.

  • If you choose to withdraw your application, you won’t get the $75 CAN sponsorship fee back. You’ll get all other fees back.
  • If you want us to keep processing, you won’t get any fees back.

Do you have proof of income that youforgot to declare and somewhat discovered 4 years later? Have you identified a filing error? Otherwise I’m not sure how waiting for you taxes to be reassessed will lead to you earning over LICO.

How many family members were you applying for? Has your income increased substantially since 2018? How much exactly are you short and what was the LICO? Short $500 if LICO is 44k is actually a decent amount.

We applied for 4 people and yes the household income has significantly increased in 2019 and 2020 only the 2018 which is short by $759 to meet lico, so far only received letter saying the same and asked for the biometrics in a separate email. No refusal as of now

Did you select the option to continue processing the application even if the sponsor is refused? If so, IRCC will continue to process the application (per your instructions) and will not send the refusal until the end. If you did not select this option, then you can expect the refusal letter earlier.
