Hi,
my friend have a criminal record (Petty theft in usa). He got deffered judgement in this case and got one yr probation with some fine. Later this case disolved with no-convication. However police reports shows "case disolved with no conviction" but still shows arrest record.

Can he get PR ?
Is he inadminisible in canada with theft record?
Do he need to declare "detailed/put in jail" = yes in the appln form ?

this is a complex issue involving US and Canadian laws and trying to judge if the description you give of your friend's circumstances fit into the category of inadmissibility and when he will be considered rehabilitated and therefore able to apply for immigration to Canada, mostly it is about timescales

your friend would do well to consult an expert immigration lawyer on this

Thanks PMM. it was less then $200 and falls under POE (petty offence exception in USA immigration laws). No idea abt abt similar laws in Canada.

In Canada there is theft under $5000 which is a summary offence and over $5000 which is dual offence that it can be proceeded either summarily or by indictment.
