Person under deportation order got approval letter from CIC

One short update/question please:

When CIC at second time ask him for passport - CIC gave him extra time until Sep. 16 to provide his own passport. He sent (twice) letter to IRB board in-order release his expired passport because he cannot change his expired passport to new one with-out old one in embassy.

IRB - no answer at all.
His local CIC - no correspondence
On-Line Status - app received.

I have question behalf him - What happened if he doesn't provide his passport to CIC by Sep. 16?

it is hard for anyone to say what exactly will happen. the important thing here is that he MUST show CIC he has made reasonable efforts to receive his passport back so he can get it updated and comply with their request. if he doesn't respond at all or just says "sorry i dont have it", his application will probably be rejected. If they see he's trying and he's not getting a response from the appropriate authority, they may give him an extention or step in to help. i would also suggest getting your mp involved to see if they can reach out and get it back for him.

He needs to inform IRCC, in writing, that CBSA has the passport which is expired (which I am sure they already know since they share information). Let IRCC deal with CBSA. IRCC will ask CBSA to send the passport to the embassy of the nationality of the person.

He can also go to his embassy/consulate/mission in the city he resides and ask them to write a letter to CBSA to advise them that he needs to renew his passport and that in order for a renewal to be done, the embassy will need the expired passport because the expired passport must be submitted to apply for a new one.

The embassy will advise CBSA that once the new passport is issued that they will send the passport back to CBSA but advise them that they will be providing a certified copy of the passport to the applicant for submission to IRCC since he has a pending PR application. CBSA will send the expired passport to the embassy for renewal.

Once the new passport is issued and received by CBSA, then they will send issued passport to IRCC.

1. IRB doesn't seize passports, it was either seized by CBSA or IRCC, it depends on where s/he claimed refugee status.

I didn't send anything to any where. I think there is not lots of "play" room about who and why write post behalf.
But anyways I appreciated for all your answers, doesn't matter if you used 'you', he' 'or she' if it can help to person - that great.

Like I understand him he sent mails to the same address where he applied for refugee and where Canada have seized his passport.

in your friend case, since he/she got AIP and have file transferred to local office its most probably the wait for Interview call, Order case file and read what trigger the Interview

In the meantime if he receive a call from CBSA for Interview go for it, It's most likely for removal ready, when CBSA see you have sponsorship file they might request CIC to expedite and wait for the sponsorship outcome before deporting him

In my case my husband received passport request and police clearance only after our Interview, However his passport is with CBSA, There is no way CBSA will release the passport.

What we did is we wrote a letter to CBSA attached with passport request letter by CIC, CBSA then wrote back saying they will not release the passport due to pending refugee case and it will be handed over to CIC upon confirmation of PR

The letter also says that we can use this to present it as a proof that we try to obtain his passport

We then send the letter we received from CBSA to our VO, After our Interview our VO provided us her email for any updates so it was easy for us to communicate with our VO and she waived passport request, within a month we were called for Landing Interview

During Landing Interview my husband was given his passport

This case has me a little bit annoyed to be honest.

This person does not have legal status in Canada, and has not had it for a while. And now he wants to apply for PR? I find it kind of rude. It is cases like these that clog up and slow down the entire process for all of the legit cases where families are WAITING to be reunited. Instead this guy just stays here, does pretty much whatever he wants. I have no sympathy for him actually.

And they also wrote deportattion on the report,but I think he finished his study at the university before leaving, maybe he wasn't really forced to leave. Yes, this should have been mentioned in your application. There is a specific question on the background form that asks if the applicant has ever been refused entry, asked to leave any country.. your answer should have been yes. If you answered no, you could face some misrepresentation accusations which might ban you from Canada for some time. Not sure where you are in the process of the application, but maybe you still have time to correct it. Although if CIC already has the FBI reports, might be too late to try to correct it.. I'm no expert in this so I can't say for sure.. Good luck.
