Can someone please advise, I have submitted my LAA and waiting nomination but my post graduate work permit will be expiring December 9th. I plan to apply for an open work permit to enable me continue to work for the same employer. Do I need to also apply for Temporary Resident Permit to have legal status to remain in Canada or is the Open Work Permit application sufficient?

Work permit will suffice.
The WP is your status document - shows you are allowed to work and reside (temporarily) in the country. If you have a WP, you are authorized to work, and by extension, reside (you are a temporary resident/temp foreign worker) in the country, for the duration as detailed in the WP.

what is LAA? what does it mean?

by the way for a (bridging) open work permit you need your AOR (Acknowledgment of Receipt)

from CIC:
Applicants applying for a BOWP must include a copy of their Acknowledgment of receipt - Application for permanent residence letter with their open work permit application.

Note: Foreign nationals in the Provincial Nominee Program (PNP) are eligible for a BOWP only if they have provided a copy of the nomination letter issued by the nominating province or territory along with their application and there is no indication that employment restrictions exist as conditions of the nomination.

http://www.cic.gc.ca/english/resources/tools/temp/work/prov/bridging.asp

so probably you can't apply for a BOWP

and there are two options left which is:
1. closed WP based on R204(c) exemption with a support letter from your province
http://www.cic.gc.ca/english/resources/tools/temp/work/opinion/territories-provinces.asp

2. WP based on LMIA

LAA is letter of Application to Apply which is issued by the Manitoba Provincial Nominee office for an individual to submit an application for provincial nomination after his EOI has been selected.

So in my case, I submitted my application October 10th and am hopefully waiting nomination soon since I know I have met the eligibility criteria for the stream I am applying under.

It however seems from the comment provided, I cannot apply for an open work permit nor a closed work permit as either case requires nomination letter from the province and I do not have that and my job also do not have an LMIA.

What do I do to remain in status beyond December 9th pending receipt of the provincial nomination? Should I apply for the Temporary Resident Permit along side a Work Permit? It seems the Temporary Resident Permit is given in exceptional circumstance for someone to remain and be in status.

Please any help for direction will be much appreciated.

first contact MPNP as soon as possible and ask them about your situation with your WP
and ask them about a R204(c) support letter for a WP.
This might be the only chance for you if you want to continue to work in canada

Thanks for your contributions. From my research reading up information in CIC website, it seems applying for TRP and WP at the same time is the way forward pending receipt of the nomination.

I will also however contact the MPNP office as advised.

to continue to work you must have LMIA or R204(c) support letter for the WP
so your problem is not really your TRP your problem will be to get a WP

I never had to apply separately for a TRP only a WP.

WP alone allows you to work and also grants you temporary residence. IMM5710 is an application to extend your stay as a worker (you are a temporary resident with worker status - can reside and work)

There is a certain confusion on what temporary residence refers to or if you need a separate permit to reside. Mostly the literature in CIC refers to temporary residence with the following status
- temporary resident as a visitor (can stay for a period of time but no authorization to work) - WP
- temporary resident as a worker (can stay for a period of time and has authorization to work) - visitor record or stamp on PP
- temporary resident with a TRP - exceptional circumstances

Start here: http://www.cic.gc.ca/english/information/applications/guides/5554ETOC.asp
Note:
A work or study permit, or a Temporary Resident visa is not a Temporary Resident Permit. These documents are clearly marked as visas or work and study permits. You are not a temporary resident permit holder unless you are inadmissible and you have been issued a document specifically identified as a Temporary Resident Permit. TRPs are only issued in exceptional circumstance and at the discretion of the processing officer. A TRP may be cancelled at any time.

Filing a WP is your tack - and to get that - as what then other posters said - there are requirements.

As a follow-up to previous comments, I submitted a request for open work permit and TRP via paper application before my status expired in December 9th, just to be in implied status. I have not received any acknowledge and file number for my submission.

However I have now received nomination and a work permit support letter from MPNP.

How do I get my nomination and the support letter to CIC so that these documents can be included to the already submitted WR and TRP documents for the application to be approved? - The work request application was paper process by mail and I have not received any file number or acknowledgement.

I paid the correct and complete fee online and have been trying to call CIC severally to make enquiry on what to do but no response.
