I'm a Canadian citizen currently living in Italy with my husband. We wanted to visit my family in Canada and stay for 6 months and my husband would like to have a working permit for those 6 months.

The problem is that he is currently awaiting to see if he will be charged with leaving the scene of accident. He was never arrested or charged. He is simply waiting to see if he will be charged. This was almost 4 years, as some of you might not know, in Italy these things go very very slow. He left the scene of accident because the other driver was being very aggressive so my husband left to go home, 2 minutes away, called the cops and explained what happened but because he left the scene of accident, he could potentially be charged. He was also told they do not call him within one more year, they cannot charge him anymore because of the time limit.

Does anyone know what type of visa can we apply under? Does he need police clearance certificate for temporary working permit? Any suggestions?

Thank you in advance!

Job Offer........
Pre-Assessed..
Hi, unfortunately this may not be easy. To work in Canada, your husband needs a job offer and the prospective employer must get a Labour Market Opinion by satisfying HRSDC/Service Canada that no Canadians applied for or were available for the job in question. Only if an LMO is granted can your husband apply for a work permit, but he must then satisfy Citizenship and Immigration Canada that he’s qualified to do the job and will leave at the end of his permit.

A police clearance certificate may be required at CIC’s discretion.

See the following CIC link re: determining eligibility to work in Canada: http://www.cic.gc.ca/english/work/apply-who-eligible.asp

Thanks for your reply!

Would you happen to know if temporary residence is an option in our situation? Is a person allowed to work on a temporary residence?

He would most likely be allowed to visit for 6 months. Visitors aren't allowed to work.

A temporary resident visa is for people who require a visa to enter Canada. He's Italian (I presume) so he's visa exempt. If he gets papers to visit Canada, he would get a Visitor's Record, not a TRV. In either case, neither allow the holder to work without a valid work permit.

Finding an employer that will go through the trouble to get a work permit for only 6 months isn't likely to happen. It's hard enough to get a employer to help with this even if you want to stay in Canada for years/permanently. Many jobs simply don't qualify to hire a foreign worker and many employers won't even consider it.

Depending on his age, he could apply for a holiday working visa. They differ by country, but usually you can get 1 or 2 max per lifetime. (I'm not at all familiar with the Italian visas, so you should read up on it - the rules differ greatly between countries.) They are not extendable, although if you decide to stay in Canada, it is easier to transition from a Working Holiday Visa to a regular closed work permit (as long as the employer is willing - it's easier for the employer too).

A temporary resident visa is just another word for a tourist visa. You aren't allowed to work on a tourist visa. As others have explained, if your husband want to work while in Canada, he will first have to find an employer, that employer will have to obtain an approved labour market opinion and then your husband will have to apply for a work permit.

Expect it to be difficult to find an employer willing to go through the LMO process.
