Can a Permanent Resident of PNP sponsor her spouse, residing outside Canada, to get an Open Work Permit?

If the person sponsoring is already a PR, then no, their spouse does not qualify for an open work permit.

This is not the same question as the one that you asked in http://www.canadavisa.com/canada-immigration-discussion-board/if-my-spouse-becomes-pr-from-opw-will-my-spousal-opw-get-cancelled-t245587.0.html Why are you not in the PR application as a dependent?

Hi zardoz,

My wife submitted her PR application under PNP before we got married, so she did non include me as a dependent.

While she is waiting for her PR grant, she obtained an OPW with TRV. She is working in Canada right now. Her OPW will expire soon on May 2015.

If she sponsors me now with an OPW, it's expiry will be the same as hers (May 2015). So we just decided to apply only after she renewed her OPW on Feb 2015. We also believe that I have more chances of getting a job with a later expiry on the OWP.

So 3 questions:

1. If her PR is granted before I get the chance to apply for a spousal OPW, will she still be able to sponsor me with OPW?

2. Can she add me as a dependent on her PR application while it is in mid-process?

3. Do you have a suggestion on what action to take, given our situation?

Thanks a lot! Really really appreciate your response.

1. No.
2. Yes - she must add you as a dependent if you get married before her PR is granted.
3. If you are now married then your wife MUST add you to her PR application.

Absolutely 100% agree. Please note the word "must". It is NOT an option... Failing to do so could result in being reported for an offence of "misrepresentation" and a potential 2 years ban from Canada.

Just an update, the Canadian Embassy in Manila is requesting our passports for our PR application.

However, my wife is already residing in Toronto and I am in Singapore.

Can we mail our passports to the Manila Embassy separately? In their email, I get the impression the Embassy is expecting the passports together.

Can you please advise! Thanks so much!
