Permanent Resident for undergraduate students

Hi there,

I want to apply for a permanent resident in Canada. However, I would like to know if I am eligible for it before I gather all the required documents for the application. So, I am going to tell you a little bit of my background. I have been in Canada since January 2004 and I was on a study permit. I went to Simon Fraser University for undergraduate degree (Bachelor of Arts in Economics). While I was in school, I had worked part time as a sandwich maker at Mr. Sub for 1 year. I also had volunteer as a treasurer in one of the SFU non profit organizations. After my graduation in Dec 2010, I applied for a work permit and got a job offer from CIBC. I am currently working full time as a CIBC bank teller for 8 months now. Hence, my question is that "Am I eligible for applying a permanent resident in Canada?" In addition, "what are the necessary steps I should take if I am eligible for it?"

Assume you mean you graduated in Dec 2009. No, you are not yet eligible to apply under CEC. You do not state if you were a full-time student during your last 2 years. If so, you would need 1 year of post-graduation employment in a skilled occupation (NOC skill level O,A, or B). Bank teller is skill level C, it does not qualify. Check the CIC website for more information.

If you can get promoted to a skilled job or get a skilled job somewhere else, you could apply under CEC after 2 years of working under the new NOC or if you have enough points, you could apply under FSW with a job offer or you could get sponsored under PNP.

Ironically, if you had stayed a sandwich maker and had made it to shift manager, you would be considered skilled. Bank teller is not.

actually, you need only 1 year of full-time work as a skill worker, since you are a Canadian graduate.

Yes but he has a time limit to do his 1 year of full time work after his graduation. If his studies meet the requirements for CEC, he would have 2 years after his graduation to complete his 1 year of full time skilled work. Now, he says he graduated in Dec. 2010 which doesn't really make sense because he says he graduated, applied for a work permit and since then has worked 8 months in a full time job. He must mean he graduated in Dec. 2009 which would mean that he has exactly one year left to work full time for a year which would mean he needs to change to a skilled job right now if that is supposed to work.

Actually he'll have as long as his permit allows him to get the experience. However the catch is for his work experience to count, it can't be dated more than 2yrs from the date of application. If he had 2yrs from graduation to gain one year work experience, immigration would have just given a 2yr work permit. Your claim renders one year on our psgw useless.

This is true, my understanding of that clause may be wrong. He must gain his work experience after graduation and his work experience must be within 2 years of his application is all it really says. It is true that it doesn't say anything about how long it can be between graduation and starting that work experience but it also doesn't say that the work experience must be done on a PGWP. If your understanding is correct, you could do a 2 yr. degree, come 10 years later on a regular work permit, work for a year and then apply under CEC as a graduate. If my understanding is correct, it's not like your 3rd year of PGWP is useless because it allows you to stay in Canada and work while your CEC is being processed.

from my understanding, it says that Canadian graduates must have gained 1 year experience in 2 years from the day the application was sent. It has nothing to do with whether you have PGWP, or when you graduated from college. As long a you gained your experience legally, and in the 2 years range before you applied, you are eligible.
